Chap. 213.—An ACT to amend and re-enact Section 914 of the Code of Virginia,
relating to the condemnation and quarantine of cattle affected with tuberculosis
or Bangs disease, so as to allow the State Board of Agriculture or State Vet-
erinarian, in lieu of immediate slaughter of Bang’s disease reactors, to enter
into certain agreements with owners of herds. [S B 190]

I. Be it enacted by the General Assembly of Virginia, That section
nine hundred and fourteen of the Code of Virginia be amended and re-
enacted, as follows: a
Section 914. A report of all tests for tuberculosis and Bang’s dis-
ease shall, within five days from the date of such tests, be made to the
State board of agriculture and immigration. All cattle found, upon tests,
to be affected with tuberculosis and all reacting positive to the agglutina-
tion test for Bang’s disease in the laboratories of the Virginia department
of agriculture and immigration shall be immediately condemned and
quarantined by the State veterinarian or other veterinarians appointed
or deputized. :
All condemned cattle shall be appraised at their fair cash value by
three persons: one to be appointed by the State board or State veterin-
arian or other agent duly authorized by the board or its veterinarian, one
by the owner, and the third by the two thus selected ; and their appraise-
ment shall be made in writing and shall be returned to the State board.
Within ninety days after the tests are made, or within such other
period of time as the State veterinarian may require, the owner or cus-
todian of all diseased cattle shall sell or slaughter such cattle, or cause
such cattle to be slaughtered, under State or Federal supervision, or
under rules and regulations of the board, and the carcasses shall be
disposed of under rules and regulations prescribed by the State board
or State veterinarian and the proceeds retained by or paid to the owner.
Should the owner or custodian fail to slaughter any condemned animal
within the period provided above, the State veterinarian, or anyone
authorized by him, may forthwith seize such condemned animal and
slaughter the same. ,
Provided that the State board or State veterinarian may, in its or his
discretion, in lieu of immediate slaughter, as heretofore provided in this
section, enter into uniform, optional, written agreements with owners of
herds; (1) for test and slaughter with indemnities and supervisory control
of calfhood vaccination, or (2) for supervisory calfhood vaccination,
coupled with permission for the retention by owners, of positive reactors,
and the gradual elimination thereof, without indemnities, under the super-
vision and control of the State board or State veterinarian, and the re-
placement, in herds by vaccinated calves as they come into milk, and with
the consent of the State veterinarian, first obtained, of cattle reacting
positive to tests for Bang’s disease.
