Chap. 200.—An ACT to amend and re-enact Sections 4, 7 and 8 as heretofore
' amended, of an act entitled “An act to provide for a new charter for the town
of Farmville.”, approved February 10, 1890, relating to the mayor and council-
men of the said town, and to further amend the said act by adding thereto a new
section numbered 11-b, authorizing the appointment and fixing the compensation
of bail commissioners therein. [S B 289]

1. Beit enacted by the General Assembly of Virginia, That sections
four, seven and eight, as heretofore amended, of an act entitled “An act
to provide for a new charter for the town of Farmville.”, approved
February tenth, eighteen hundred and ninety, be amended and re-enacted,
and that the said act be further amended by adding thereto a new section
numbered eleven-b, so that the said amended sections and the said new
section shall be as follows:

Section 4. The municipal authorities of the said town shall consist
of a mayor and seven councilmen, who shall be. elected on the second
Tuesday in June, nineteen hundred and forty-two by the qualified voters
of the town. Three of the councilmen so elected receiving the lowest num-
ber of votes shall hold office for a term of two years beginning on the
first day of September next following the date of their election and until
their successors are duly elected and qualified. The other four councilmen
so elected receiving the highest number of votes shall hold office for a
term of four years beginning on the first day of September next following
the date of their election and until their successors are duly elected and
qualified. At the regular election to be held on the second Tuesday in
June, nineteen hundred and forty-four and every two years thereaiter, a
successor for each councilman whose term expires during the year in
which the said election is held shall be elected by the qualified voters of
said town; the mayor and each councilman so elected shall hold office for
a term of four years beginning on the first day of September next follow-
ing the date of his election and until his successor 1s elected and qualified.
All persons qualified to vote in said elections shall be eligible to either of
said offices. The term of all members of the council, including the mayor
in office at the time of the adoption of this amendment, as well as the
term of all councilmen elected or appointed to fill the unexpired term of
any councilman, shall expire on the thirty-first day of August, nineteen
hundred and forty-two.
Section 7. The mayor and councilmen shall before entering upon
their respective duties take oaths prescribed for all other government
officers by the laws of Virginia; but if any or either of them shall fail so
to do for thirty days after the commencement of the term for which he or
they are elected, his or their offices shall be deemed vacant. They shall as
soon after September first, nineteen hundred and forty-two, as may be
convenient, and every year thereafter, elect a town sergeant and likewise
a town treasurer, who shall hold office for a term of one year and until
their successors are elected and have qualified ; and the treasurer so elected
shall perform the duties hereinafter particularly set out and such other
duties as may be prescribed by the council electing him.
Section 8. Whenever, from any cause, a vacancy shall occur in the
office of mayor or councilmen, the same shall be filled by the council from
the qualified electors of said town, who may or may not then be a mem-
ber of the then existing council, and an entry of said election shall be
made of record.
Section 1l-b. The council of the town of Farmville may appoint
one or more persons, who may or may not be members of the council, as
bail commissioners, who shall have power and jurisdiction to admit tc
bail persons charged with violations of the ordinances of the town. The
term of office of said commissioners shall be at the pleasure of the coun-
cil. The commissioners may charge and receive from the person for whom
services are rendered the same fee for admitting to bail and other services
as allowed by law to justices of the peace, provided, however, that nc
commissioner who receives a salary from the town shall receive any fee
for admitting any person to bail or for any services whatever ‘rendered by
him in connection with any criminal cases. The town of Farmville shall
in no case be liable for any bail fee.
2. An emergency existing this act shall be in force from its passage.
