Chap. 164.—An ACT to amend and re-enact Section 8, and Section 53 as amended,
of the Motor Vehicle Code of Virginia, Section 8 so as to eliminate the fee in
cases of arrest as well as conviction, Section 53 so as to include both sides in
determining character of the highway. [fH B 138]

1. Be it enacted by the General Assembly of Virginia, That section
eight, and section fifty-three as amended, of the Motor Vehicle Code of
Virginia, be amended and re-enacted, as follows:
Section 8. Enforcement by officers of counties, cities, and towns.—
Every county, city, town or other political subdivision of the State shall
also enforce the provisions of this act and of the motor vehicle laws of
the State of Virginia through the agency of any constable, peace or police
officer, sheriff or deputy, provided that such officer shall be completely
uniformed at the time of such enforcement or shall display his badge or
other sign of authority, and with the further provision that all officers
making arrests incident to the enforcement of this act and of the motor
vehicle laws of this State shall be paid, fixed and determined salaries for
their services, and shall have no interest in, nor be permitted by law to
accept the benefit of any fine or fee resulting from the arrest or conviction
of an offender against any provision of this act or of the motor vehicle
laws of the State of Virginia.
Section 53. Uniform marking and signing of highways.—The
State Highway Commission is hereby authorized to classify, designate
and mark State highways and to provide a uniform system of marking
and signing such highways under the jurisdiction of this State, and such
system of marking and signing shall correlate with and so far as possible
conform to the system adopted in other states. The driver of a motor
vehicle, trailer or semi-trailer shall stop, slow down or regulate the speed
of such motor vehicle, trailer or semi-trailer to accord with requirements
of road signs erected upon the authority of the highway commission or
local authorities in cities and towns and the failure of such driver to
comply with this provision shall constitute a misdemeanor and upon
conviction shall be punished in accordance with the provisions of section
one hundred and eighteen.
(a) The territory contiguous to a highway where seventy-five per
centum or more of the total frontage, on both sides of the highway, fora
distance of three hundred (300) feet or more is occupied by buildings
actually in use and operation for business purposes shall constitute a
business district for purposes of this act.
(b) The territory contiguous to a highway not comprising a
business district, where seventy-five per centum or more of the total
frontage, on both sides of the highway, is mainly occupied by dwellings
or by dwellings and buildings in use for business purposes, shall be
defined as a residence district for purposes of this act.
