Chap. 158.—An ACT to amend and re-enact Section 2702 of the Code of Virginia,
as amended, relating to the holding of more than one office by certain officers,
so as to provide that a deputy sheriff of a county may also be town sergeant of.a
town within such county, and a county surveyor of one county may be county
surveyor of another county. [S B 121]

1. Beit enacted by the General Assembly of Virginia, That section
twenty-seven hundred and two of the Code of Virginia, as amended, be
amended and re-enacted, as follows:
Section 2702. No person holding the office of county treasurer,
sheriff, attorney for the Commonwealth, county clerk, commissioner of
the revenue, superintendent of the poor, county surveyor, or supervisor
shall hold any other office, elective or appointive, at the same time, ex-
cept that of a city or town attorney, notary public, commissioner in chan-
cery, commissioner of accounts and local registrars of deaths and births,
and member of any commission or board appointive by the Governor, and
a commissioner of the revenue of a county may also be commissioner ot
the revenue of a town located in said county, and a county treasurer of a
county may also be treasurer of a town located in said county, also that
game wardens may be employees of the federal forest reserve, and ex-
cept also that a county surveyor may, at the same time, hold the office
of oyster inspector, and if any person shall be elected or appointed to two
or more offices except as herein provided, his qualification in one of them
shall be a bar to his right to qualify in any of the offices enumerated, and
if any person while holding any of such offices shall be appointed or elected
to any other office, his qualification in such office shall thereby vacate any
of the above offices he then holds, except as provided as above. Provided
that an attorney for the Commonwealth may be employed or appointed by
the attorney general as a special prosecutor in prohibition cases ; and pro-
vided, further, that any deputy sheriff of any county may also hold the
office of town sergeant of any town within such county, and provided,
further, that a county surveyor of one county may hold the office of county
surveyor of another county.
