Chap. 90.—An ACT to validate acknowledgments to deeds of trust, taken by persons
who are trustees therein and who are also officers authorized by law to take
acknowledgments. [S B 118]
Approved February 26, 1940
Whereas, numerous deeds of trust conveying land in the State of
Virginia have been acknowledged before and certified by persons
authorized by law to take acknowledgments and who were trustees
in said deeds: and,
Whereas, a doubt has arisen as to the authority of such persons
to take and certify such acknowledgments to deeds in which they,
the said persons, were trustees; now, therefore,
1. Be it enacted by the General Assembly of Virginia, That all
certificates of acknowledgments to deeds of trust heretofore made
and certified by such persons being trustees in said deeds, shall be
held and the same are hereby declared valid and effective in all
respects, if otherwise valid according to the law then in force; and
each such deed of trust which has been admitted to record in any
clerks office in the State of Virginia, upon such a certificate, shall be
held to be duly and regularly recorded if such recordation be other-
wise valid according to the law then in force.
Provided, however that nothing in this act shall effect or diminish
the rights or remedies of any person which have intervened since
the spreading of any such deed of trust on the record.
2. An emergency existing, this act shall be in force from its
passage.
