Chap. 62.—An ACT to authorize and empower the State Board of Health to convey
to Craig-Botetourt Electric Cooperative, Incorporated, a perpetual right of
way over certain lands of the Catawba Sanatorium and the Commonwealth of
Virginia, to be used for the transmission and distribution of electricity. [{H B 63]

1. Be it enacted by the General Assembly of Virginia, That
the State Board of Health be, and it is hereby authorized and em-
powered, for and on behalf of the Commonwealth of Virginia, to
transfer and convey to the Craig-Botetourt Electric Cooperative,
Incorporated, by proper deed or deeds, signed and executed by such
person or persons as shall be authorized by the State Board of Health,
with special warranty of title, and without consideration, the right,
privilege and easement of right of way to construct a pole line for
the transmission and distribution of electricity, including the neces-
sary attachments, wires, ground connections, equipment and acces-
sories in connection therewith, upon, over and across the property
of the Commonwealth of Virginia, known as the Catawba Sanatorium
property, situated in Roanoke County, Virginia, and the right to
maintain and operate the same so long only as the said Craig-Bote-
tourt Electric Cooperative, Incorporated, shall continue in operation
as a non profit organization, the center line of such right of way being
briefly described as follows:
Beginning at the boundary line of C. W. Crawford, which
point is N. 15° 45’ W. 19 ft. over a stone set in the ground, corner
of C. W. Crawford, F. J. Chapman and Catawba Sanatorium;
thence entering the Catawba Sanatorium property the following
courses and distances: S. 58° 30’ W. 277 ft. to the electric trans-
mission pole of the Cooperative, No. C-175; thence S. 58° 30’ W.
316 ft. to pole C-176; S. 58° 30’ W. 187 ft. to pole C.-177; S. 44°
W. 287 ft. to Pole C-178; S. 44° W. 338 ft. to pole C-179; S. 44°
W. 259 ft. to pole C-180; S. 44° W. crossing State highway, route
# 123, 53 ft. from pole C-180, 158 ft. to pole C-181 S. 44° W. 330
ft. to pole C-182;S. 44° W. 179 ft. to pole C-183; S. 82° 45’ W. 280
ft. to pole C-184; S. 82 45’ W. 205 ft. to pole C-185; N. 89 15’

leaving the land of the Catawba Sanatorium and entering the
land of Charlie Twine, S. 38° 15’ E. 48 ft. to a chestnut stump,
the corner of Morgan, Charlie Twine and the Catawba Sana-
torium, said right of way being 20 feet in width:
together with full right to the Craig-Botetourt Electric Cooperative,
Incorporated, its agents and employees, at all times to have full and
free ingress to and egress from and over the adjoining property in
order to construct, operate, maintain and repair the lines and appur-
tenances, with the right to inspect, rebuild, repair, improve and re-
locate along the route above described, and to remove and make
such changes, alterations and substitutions in said lines, wires, poles,
attachments, equipment and accessories as the Craig-Botetourt
Electric Cooperative, Incorporated, may from time to time deem
advisable or expedient, including the right to trim, cut and keep
clear all trees, limbs and undergrowth and other obstructions along
said right of way, or adjacent thereto that may in any way endanger
or interfere with the proper and efficient operation of the same; the
said poles, wires, attachments, equipment and accessories erected
thereunder to be and remain the property of the Craig-Botetourt
Electric Cooperative, Incorporated. ,
2. An emergency existing, this act shall be in force from its
passage.
