Chap. 392.—An ACT to amend and re-enact an act entitled ‘‘An act to authorize
and empower the board of supervisors of counties adjacent to counties having a
density of population in excess of five hundred inhabitants per square mile, to
lay a special levy annually, for fire protection’, approved March 22, 1930, as
heretofore amended, so as, among other purposes, to prescribe how the funds
obtained from such special levy shall be expended; and to repeal Chapter 320
of the Acts of the General Assembly of 1936, approved March 26, 1936, dealing
with the same subject. [H B 447]

1. Be it enacted by the General Assembly of Virginia, That an
act entitled ‘‘An act to authorize and empower the board of super-
visors of counties adjacent to counties having a density of population
in excess of five hundred inhabitants per square mile, to lay a special
levy annually, for fire protection’’, approved March twenty-second,
nineteen hundred and thirty, as heretofore amended, be amended
and re-enacted so as to read as follows:
Section 1. It shall be the duty of the president of the county
volunteer firemen’s association of any county adjacent to a county
having a density of population in excess of five hundred inhabitants
per square mile, not later than February first of each year to lay
before the board of supervisors of the county a budget showing the
estimated amount of money necessary for fire protection in the county
for the following year, including indebtedness on necessary fire
equipment heretofore purchased, which budget shall be inspected by
said board, and if it meets with their approval, the amount thereof
shall be included in the county budget; or should a portion of such
budget be approved and a portion of such budget be disapproved,
the amount approved shall be included in the county budget for such
year.
Section 2. The board of supervisors of any such county is hereby
authorized and empowered to lay a special levy each year, in addition
to any levy now authorized or required by law, at the time the other
county and district levies are laid, which levy shall be included in
the county budget for such year, on all property subject to taxation
by the county, for the purpose of fire protection in the said county.
Section 3. Said fund so raised by said special levy shall be used,
in the discretion of the said board of supervisors, for the payment of
any indebtedness heretofore or hereafter incurred by any volunteer
fire fighting company recognized as such by the board of supervisors
of said county, located in said county, in the purchase of necessary
fire fighting equipment, and for the purchase, by the board of super-
visors, of any necessary fire fighting equipment which, in the discre-
tion of said board, may be needed by any such recognized fire fighting
companies in said county, and said fund may also be used, in the
discretion of said board of supervisors, for contracting with any
individual, corporation, organization, association or municipal corpora-
tion, located within or without said county, or located partly within
and partly without said county, for services rendered in affording fire
protection in said county, or said board may contribute a portion of
said fund to any fire fighting company located within or without or
partly within and partly without said county that renders fire pro-
tection in said county.
Section 4. The said board of supervisors is hereby authorized
and empowered to adopt such reasonable rules and regulations in
reference to the disbursement of said fund as they may deem fit and
proper.
Section 5. All Code sections and acts, and parts of sections and
acts, inconsistent with this act are hereby repealed, to the extent of
such inconsistency.
2. Be it further enacted by the General Assembly of Virginia,
That Chapter three hundred and twenty of the Acts of the General
Assembly of nineteen hundred and thirty-six, approved March twenty-
sixth, nineteen hundred and thirty-six, be, and the same is hereby,
repealed.
3. An emergency existing, this act shall be in force from its
passage.
