Chap. 26.—An ACT to amend and re-enact Chapter 94 of the Acts of the General
Assembly of 1934, approved March 7, 1934, and known, designated and cited
as the Alcoholic Beverage Control Act, by adding thereto a new section, num-
bered 14, so as, among other things, to provide for the furnishing of counsel to
the members, agents or employees of the Virginia Alcoholic Beverage Control
Board should they be sued, arrested, indicted, or otherwise prosecuted because
of any matter arising out of their employment; and to provide for the compen-
sation of any counsel so employed. [S B 29]

1. Be it enacted by the General Assembly of Virginia, That
Chapter ninety-four of the Acts of the General Assembly of nineteen
hundred and thirty-four, approved March seven, nineteen hundred
and thirty-four, and known, designated and cited as the Alcoholic
Beverage Control Act, be amended by adding thereto a new section,
numbered fourteen, which new section shall read as follows:
Section 14. If any member, agent, or employee of the Virginia
Alcoholic Beverage Control Board shall be made defendant in any
civil action for damages arising out of any matter connected with his
official duties, he may, in the discretion of the Attorney General, be
represented in such action by the Attorney General or one of his
assistants. If, in the opinion of the Attorney General, it is imprac-
ticable or uneconomical for such legal service to be rendered by him
or one of his assistants, the Attorney General may employ special
counsel for such purpose, whose compensation shall be fixed by the
Attorney General.
If any member, agent, or employee shall be arrested, indicted, or
otherwise prosecuted on any charge arising out of any act committed
in the discharge of his official duties, the Chairman of the Virginia
Alcoholic Beverage Control Board may, with the approval of the
Governor, employ special counsel to defend such member, agent, or
employee. The compensation for special counsel employed, pur-
suant to this act, shall be paid in the same manner as other expenses
incident to the administration of the Alcoholic Beverage Control
Act are paid.
