Chap. 202.—An ACT to amend and re-enact an act entitled “An Act to require the
sheriff and his deputies and all other officers of the county of Buchanan, author-
ized to make arrests, to wear uniforms or some insignia of office, while in per-
formance of their duties, and to provide for forfeiture of office for failure to
comply with such requirement.”’, approved March 26, 1938, so as to make
certain exceptions. [H B 326]

1. Be it enacted by the General Assembly of Virginia, That an
act entitled ‘‘An Act to require the sheriff and his deputies and all
other officers of the county of Buchanan, authorized to make arrests,
to wear uniforms or some insignia of office, while in performance of
their duties, and to provide for forfeiture of office for failure to com-
ply with such requirement.”, approved March twenty-sixth, nineteen
hundred and thirty-eight, be amended and re-enacted so as to read
as follows:
Section 1. The sheriff of the county of Buchanan and all of his
deputies, and all other officers of said county authorized by law to
make arrests, except attendance officers appointed under the pro-
visions of section six hundred and eighty-five of the Code of Vir-
ginia, are hereby required either to wear uniforms or to wear, con-
spicuously displayed on their clothing, such insignia of office as will
make them readily recognizable as officers, at all times while in the
performance of their duties as such officers. The sheriff, or any
deputy sheriff, or any other such officer of said county, who shall
not be wearing such uniform or insignia of office at the time he makes,
or assists in making, any arrest, shall forfeit his office, which for-
feiture shall be entered of record by the circuit court of said county,
upon such fact being shown to the court.
