Chap. 106.—An ACT to validate certain pay-roll checks of the State Department
of Highways which were fraudulently obtained and used by M. S. De Huff, an
Engineer employed by the said Department, and transferred by him without
notice and for value to certain persons, firms, associations and corporations.

1. Beit enacted by the General Assembly of Virginia as follows:
Section 1. All pay-roll checks of the Department of Highways
which, as shown by a report of the Auditor of Public Accounts on
an examination of the accounts of M. S. De Huff, Engineer of the
Department of Highways, dated November twenty-ninth, nineteen
hundred and thirty-nine, and filed with the Governor of Virginia,
were issued between the first day of February, nineteen hundred and
thirty-four and the third day of August, nineteen hundred and thirty-
nine at the instigation of one M. S. De Huff, an engineer employed
by the State Department of Highways, and which were made pay-
able to certain fictitious persons or to persons not entitled to receive
and use the same and were thereafter wrongfully obtained by the
said M. S. De Huff and transferred by him without notice of any
defects therein and for value to certain persons, firms, associations
and corporations, and which were later paid by banks acting as State
depositories and charged against the account or accounts of the
Treasurer of Virginia therein, be, and the same are hereby, validated
and confirmed, and shall be held and considered to have been binding,
legal, valid and enforceable obligations of the Commonwealth of
Virginia while in the hands of any person, firm, association or corpora-
tion accepting, using, transferring or negotiating the same in good
faith and without knowledge of the fraudulent use thereof by the
said M.S. De Huff.
Section 2. The Auditor of Public Accounts and the Comptroller
are hereby authorized to approve such checks as constituting proper
and valid evidence of the expenditure on the part of the Department
of Highways of the funds represented thereby.
