Chap. 10.—An ACT to authorize and empower the Chairman of the State Highway
Commission to execute, in the name of the Commonwealth, deeds conveying
sections of roads or other property deemed no longer necessary for the uses of
the State Highway System; provided that such conveyance shall be approved by
the State Highway Commission by resolution duly adopted and recorded in the
minutes of the said Commission. [H_ B 27]

1. Be it enacted by the General Assembly of Virginia, That
when in heretofore or hereafter laying out, constructing or maintaining
sections of the roads in the State Highway System, a part of the said
road has been or is proposed to be straightened or the location of a
part thereof altered, and a section of the road or other property is
deemed by the Chairman of the Highway Commission no longer
necessary for the uses of the State Highway System, the Chairman
shall so certify, in writing, to the State Highway Cemmission such
facts, and it may authorize the Chairman to execute, in the name of
the Commonwealth, a deed, or deeds, conveying such sections, either
for a consideration or in exchange for other lands that may be neces-
sary for the uses of the State Highway System; but before any such
deed either for the sale or exchange of land is executed conveying
any section of a highway upon or along which any person or persons
reside, notice shall be given by the Chairman of the Highway Com-
mission to the owner or owners of said land upon which said person
or persons reside of the intention to convey said section of road, and
if, after a reasonable notice of such intention, any such land owner so
requests, a hearing shall be ordered by the Chairman of the Highway
Commission as now provided by law, and if, upon such hearing, it is
made to appear that such section of road should be kept open for the
reasonable convenience of such landowner, or the public, then such
section of said road shall not be conveyed; provided, however, that
any such conveyance shall have the approval of the Highway Com-
mission by RESOLUTION recorded in the minutes of the meeting
of the Commission.
2. An emergency existing, this act shall be in force from its
passage.
