Chap. 1.—An ACT to authorize and empower the City of Williamsburg, Virginia,
acting by and through its Mayor and Council, to grant to the United States of
America, subject to certain conditions, restrictions and reservations, a perpetual
easement in certain streets, alleys and other lands in the City of Williamsburg,
Virginia, for the construction, maintenance and operation of a permanent
vehicular tunnel forming a part of the right of way for the Colonial Parkway
through the said city; and to approve, ratify and confirm the execution by the
City of Williamsburg of a certain agreement between the said city and the
United States of America with respect to such easement. [H B 1]

1. Beit enacted by the General Assembly of Virginia, as follows:
Section 1. The City of Williamsburg, acting by and through its
Mayor and Council, is hereby authorized and empowered to grant and
convey, by proper instrument or instruments and for such considera-
tion as it may deem adequate, to the United States of America, acting
by and through the Department of the Interior, a perpetual easement
in certain lands fifty feet in width to be used for the construction,
maintenance, repair, operation and administration of a permanent
vehicular tunnel eleven hundred and eighty-three feet, more or less, in
length, forming a part of the right of way for the Colonial Parkway
through the City of Williamsburg, and passing under Nicholson Street,
Duke of Gloucester Street, England Street, Francis Street, and any
alleys or other lands which the city may own or in which it may have
any right, title and interest within the proposed tunnel area, the loca-
tion, extent and more particular description of the said easement
herein authorized to be granted being shown on Drawing No. F. O.—
C. P.—1 D 3—2, of the said Department entitled “Colonial Parkway
Tunnel’’, a copy of which is attached to and made a part of the agree-
ment hereafter mentioned.
Section 2. The execution by the City of Williamsburg of a certain
agreement of September twenty-second, nineteen hundred and thirty-
nine, between the said city and the United States of America, acting
by and through the Department of the Interior, which said agreement
grants unto the United States of America, subject to certain conditions,
restrictions and reservations fully set out therein, the said easement
referred to in section one of this act to be used for the construction,
maintenance, repair, operation and administration of the said vehicular
tunnel under certain lands in the City of Williamsburg, is hereby
approved, ratified and confirmed; and the said agreement of September
twenty-second, nineteen hundred and thirty-nine, when executed and
delivered by the United States of America, acting by and through the
Department of the Interior, shall be as valid and binding upon the
parties thereto and as fully effective for all purposes as if the said
City of Williamsburg had been first authorized and empowered under
this act to grant the said easement and to execute and deliver such
agreement.
2. An emergency existing, this act shall be in force from its
passage.
