Chap. 359.—An ACT to amend and re-enact Section 3033 of the Code of
Virginia, in relation to powers of councils of cities and towns and to
the fire departments of cities and towns rendering aid beyond the cor-
porate limits. [H B 423]

1. Be it enacted by the General Assembly of Virginia, That section
thirty hundred and thirty-three of the Code of Virginia be amended
and re-enacted so as to read as follows:
Section 3033. Powers of councils of cities or towns as to weights
and measures, transportation, protection of property, et cetera; fire
department.—The council of any city or town shall have power to pro-
vide for the weighing or measuring of hay, coal or any other articles
for sale, and regulate the transportation thereof through the streets,
protect the property of the city or town and its inhabitants, preserve
peace and good order therein; and may, in their discretion, authorize
or require the fire department thereof to render aid in cases of fire
occurring beyond their limits, and may prescribe the conditions on
which such aid may be rendered, and may enter into a contract, or
contracts, with adjacent or adjoining counties for rendering aid in fire
protection in such counties, or any district, or sanitary district thereof,
on such terms as may be agreed upon by said council, and the board of
supervisors or other governing agency of such counties and/or district,
including sanitary districts, and when the fire department of any city
or town is operating under such permission or contract, or contracts,
or any call beyond the corporate limits of the city or town, it shall be
deemed to be operating in a governmental capacity, and subject only
to such liability for injuries as it would be if it were operating within
the corporate limits of such city or town.
