Chap. 34.——An ACT to authorize, empower and direct the State Hospital Board
to convey to the city of Staunton, all the right, title and interest of the
Western State Hospital and the Commonwealth of Virginia in and to a
perpetual right of way over certain lands, to be used for street and highway
purposes. [S B 110]

Whereas, Virginia State Highway known as U. S. Route number
eleven, or Lee Highway, entering the city of Staunton from the south
is of insufficient width within the city limits to handle the increased
traffic over said route; and
Whereas, it is desirable to widen and re-locate said route within
the city of Staunton; and a ,
Whereas, a plat and survey of said proposed highway along, through
and over the lands of the Western State Hospital, in Staunton, has
been made by the State Highway Commission, and is on file in the
Department of Highways, in Richmond, Virginia, identified as Sheet
No. 3-4, Project No. 585-M]1, Route eleven, which said plat and sur-
vey shows that the center line of said highway is briefly described as
follows:
Beginning at a point on the center line of route number eleven
between 0.438 miles north of SCL of Staunton to SCL of Staunton
shown on the plans as being Sta. 4 plus 00 being the beginning of
Project; thence with a 1 degree 00 minute curve (right) 201.4 feet
to Sta. 6 plus 01.4; thence S. 26 degrees 11 minutes W. 610.6 feet
to Sta. 12 plus 12; thence with a 4 degree 00 minute curve (right) 200
feet to the point of digression being Sta. 14 plus 12; and that the land
over which the right of way to be conveyed hereunder is desired con-
sists of two strips of varying width lying on either side of the said
center line as shown on the said plan, the one lying on the east (left)
side thereof being 25 feet in width from Sta. 4 plus 00 to Sta. 13
plus 50, thence diverging from said center line and narrowing to 15
feet at a point 10 feet opposite Sta. 14 plus 00 and to 00 feet at a point
25 feet opposite Sta. 14 plus 12; and one lying on the west (right)
side thereof being 00 feet in width at Sta. 4 plus 40, thence widening
to 25 feet at Sta. 5 plus 40, and continuing 25 feet in width to Sta. 11
plus 50, and thence narrowing to 00 feet at Sta. 13 plus 50; the said
two adjacent strips or parcels of land containing 1.01 acres, more or
less, of which 0.18 acres, more or less, are included in the present
right of way, leaving 0.83 acres, more or less, outside thereof; now
therefore,
1. Be it enacted by the General Assembly of Virginia, That the
State Hospital Board be, and it is hereby, authorized, empowered and
directed, for and on behalf of the Commonwealth of Virginia, to trans-
fer and convey to the city of Staunton by proper deed or deeds signed,
and executed by such person or persons as shall be authorized by the
said board, with special warranty of title and without other considera-
tion than that hereinafter stated, all right, title and interest of the
Western State Hospital and of the Commonwealth of Virginia in and
to a perpetual right of way for street and highway purposes over and
along the said strips or parcels of land above described, together with
the right to make and maintain necessary widenings for cuts and fills
and road connections; the said conveyance to be upon the condition
that the city of Staunton at its own cost and expense shall widen the
said highway which is known as Greenville Avenue and as U. S. Route
number eleven, along the property of the Western State Hospital, and to
this end shall set back such fence and other property lines of the said
hospital which are now existing along said route, and to reset the said
fencing in as good or better condition than at present, all in accordance
with the above mentioned plan and survey of the State Highway Com-
mission. , |
2. An emergency existing, this act shall be in force from its pas-
sage.
