Chap. 330.—An ACT to amend and re-enact Section 3 of an act entitled “an
act to provide for the establishment, purchase, construction, maintenance and
operation of a radio or teletype system or any combination thereof, to be
used for transmitting and receiving messages for the detection of crime and
the apprehension of criminals, and for other police purposes; to authorize
and empower the Governor, in his discretion, to establish, purchase, lease,
or otherwise acquire real and personal property for such purpose, to vest
in the Governor certain powers in connection therewith; to provide for the
cooperation of and with the localities of the Commonwealth; and to ap-
propriate the sum of $75,000.00 for each year of the biennium beginning
July 1, 1936, or so much thereof as may be necessary, to be used by the
Governor, in his discretion, in carrying out the provisions of this act: and
to repeal Chapter 284 of the Acts of the General Assembly of 1934, as
amended, relating to the same matter”, approved January 13, 1937, so as
to appropriate the sum of $150,000.00, or so much thereof as may be necessary
for the biennium beginning July 1, 1938, for the purpose of carrying out
the provisions of this act. [S B 308]

1. Be it enacted by the General Assembly of Virginia, That sec-
tion three of an act entitled “‘an act to provide for the establishment,
purchase, construction, maintenance and operation of a radio or tele-
type system or any combination thereof, to be used for transmitting
and receiving messages for the detection of crime and the apprehension
of criminals, and for other police purposes; to authorize and empower
the Governor, in his discretion, to establish, purchase, lease, or other-
wise acquire real and personal property for such purpose, to vest in
the Governor certain powers in connection therewith; to provide for
the cooperation of and with the localities of the Commonwealth; and
to appropriate the sum of seventy-five thousand dollars for each year
of the biennium beginning July first, nineteen hundred and thirty-six,
or so much thereof as may be necessary, to be used by the Governor,
in his discretion, in carrying out the provisions of this act; and to
repeal chapter two hundred and eighty-four of the Acts of the General
Assembly of nineteen hundred and thirty-four, as amended, relating
to the same matter’, approved January thirteenth, nineteen hundred
and thirty-seven, be amended and re-enacted so as to read as follows:
Section 3. There is hereby appropriated out of any moneys in the
State treasury not otherwise appropriated, the sum of one hundred
and fifty thousand dollars, or so much thereof as may be necessary
for the purpose, for the biennium beginning July first, nineteen hun-
dred and thirty-eight, to be used by the Governor, in his discretion,
in carrying out the provisions of this act, the same to be paid by the
Treasurer on warrants of the Comptroller upon vouchers signed by
the Governor or by some person duly authorized by him for the
purpose. It is provided, however, that this appropriation shall not
become available for expenditure either in whole or in part unless
and until the Governor certifies to the Comptroller in writing that
the expenditure thereof will not create or add to a deficit in the gen-
eral fund of the State treasury; and provided further, that this ap-
propriation shall be decreased by the amount of expenditure, if any,
heretofore made under the provisions of this act. |
2. This act shall become effective on July first, nineteen hundred
and thirty-eight.
