Chap. 308.—An ACT to amend and re-enact Section 935 of the Code of Vir-
ginia, providing for a board of visitors of the College of William and Mary
in Virginia, their number, method of appointment, term and duties. [H B 216]

1. Be it enacted by the General Assembly of Virginia, That sec-
tion nine hundred and thirty-five of the Code of Virginia be amended
and re-enacted, to read as follows:
Section 935. Board of visitors; number, appointment; term;
duties—The board of visitors shall consist of ten members, to be ap-
pointed by the Governor, from the State at large, and by and with
the consent of the Senate, and shall hold office for a term of four
years. The members of the board of visitors in office when this Code
takes effect shall continue in office until the end of their respective
terms, and biennially the Governor shall appoint five members to fill
the vacancies then occurring. Within sixty days prior to March first,
nineteen hundred and thirty- eight, and biennially thereafter, the Gov-
ernor shall, by and with the consent of the Senate, appoint, for a
term of four years, the successors of those visitors whose terms are
about to expire. If a vacancy occurs in the office of a visitor at any
time during his term, the Governor shall, except as hereinafter pro-
vided, fill such vacancy by appointing stich person as he may deem
proper as visitor for the remainder of such unexpired term, subject to
ratification or rejection by the Senate at the next session of the General
Assembly if the General Assembly be not in session when such ap-
pointment is made. The Governor shall appoint at least two visitors
in the years in which he has five visitors to appoint, from a list of not
less than ten or more than twenty persons, qualified to fill the office of
visitor, which list shall be submitted to him in each such year by

Virginia, acting through its board of managers, at least thirty days
prior to the date upon which the terms of such visitors are to begin.
Any visitor.so appointed from any such list and any visitor at present
a member of the board shall, however, notwithstanding the foregoing
provision, be eligible for reappointment to succeed himself as a mem-
ber of the said board of visitors, although his name may not appear
on any such list current at the time of such reappointment. The
said list shall be made up by the said alumni association in such manner
as it shall prescribe or by the board of managers thereof if no method
is prescribed by the said association. If said list is not submitted
within the time herein required, the Governor shall disregard the pro-
visions of this section relating to the submission of such list, and
shall appoint such persons as he may deem proper.
Whenever a vacancy occurs among the members of the board af
visitors appointed by the Governor as nominees of said alumni asso-
ciation, otherwise than by expiration of term, the Governor shall
certify this fact to the alumni association and the association may submit
a list of ten persons, qualified to fill the office of visitor, from which
list the Governor shall select one, to fill such vacancy, as the nominee
of the alumni association, which list shall have the same effect as
lists filed as herein otherwise provided; but, upon failure of the alumnt
association to furnish such list within fifteen days from the date such
vacancy has been certified to the association by the Governor, the
Governor shall appoint a nominee of the alumni association from the
list last previously submitted, so as to have at least four visitors who
shall be nominees of the alumni association as aforesaid.
The said board of visitors shall control and expend the funds of
the college and any appropriation hereafter provided, and shall make
all needful rules and regulations concerning the said college, appoint
the president and all professors, teachers and agents, and fix their
salaries, and generally direct the affairs of the college.
