Chap. 301.—An ACT to amend and re-enact Section 395 of the Tax Code of
Virginia, as heretofore amended, in relation to delinquent State taxes.

1. Be it enacted by the General Assembly of Virginia, That section
three hundred and ninety-five of the Tax Code of Virginia, as hereto-
fore amended, be further amended and re-enacted so as to read as
follows:
Section 395. After one year following June thirtieth of year as
of which delinquent lists speak, what to be done as to State taxes.—At
the expiration of one year following June thirtieth of the year as of
which such delinquent lists speak, the treasurer shall transmit to the
Department of Taxation a copy of the list mentioned in the paragraph
numbered four in section three hundred and eighty-seven hereof. Such
copy of such list so transmitted shall show the changes which have
occurred since June thirtieth of the preceding year. The Department
of Taxation shall thereupon have power to issue warrants for the col-
lection of such taxes against taxpayers liable therefor in the same
manner and with the same effect as in the case of warrants issued
for the collection of taxes assessed by such department; and all pro-
visions of law applicable to such warrants shall be applicable to the
warrants issued for the collection of delinquent State taxes under this
section. Upon the receipt and auditing of such list, the Department
of Taxation shall certify to the Comptroller the necessary information
to enable him to give such treasurer proper credit therefor on his
books, and such treasurer shall not receive any of such taxes thereafter,
but the same shall be paid directly into the State treasury. The fore-
going, however, is subject to the following qualification, that in counties
containing more than five hundred inhabitants per square mile according
to the last preceding United States census, the Department of Taxa-
tion, in its discretion, may authorize the treasurer to continue to collect
and receive such taxes; and a copy of every such authorization shall
be certified by the Department of Taxation to the Comptroller.
A copy of the list of unpaid State capitation taxes mentioned in the
paragraph numbered five of section three hundred and eighty-seven
hereof shall also, at the same time, be transmitted to the Department of
Taxation by the treasurer; but such treasurer shall continue to receive
such State capitation taxes.
The Comptroller shall keep delinquent State taxes on his books
intil he receives advice from the Department of Taxation, that, in the
ypinion of such department, the claims (describing them) are worthless.
2. An emergency existing, this act shall be in force on and after its

for game refuges or hunting preserves and the purchase or
breeding of game and fish to re-stock the lands and inland
waters of the State.
For payment of fees to clerks for issuing
hunting, trapping and fishing licenses,

It is hereby provided that all monies, fees and rev-
enues collected by the Commission of Game and Inland
Fisheries shall, upon receipt thereof, be paid promptly
into the State treasury to the credit of the game protection

1936-1938 biennium shall be transferred to said fund, and all
appropriations made to the Commission of Game and In-
land Fisheries as provided in this act, shall be paid out of
the game protection fund, and not out of the general fund

In the event the Federal government should make
available funds for game and fish work, such funds as are
allocated to Virginia may be expended, subject to the
approval of the Governor, for the lease and purchase of
areas for refuges and public hunting and fishing grounds

It is further provided that the superintendent of
the Western State Hospital may, after setting aside
out of the revenues derived from the operation of the
DeJarnette State Sanatorium, a sufficient amount to pay

interest charges for the year ending June 30, 1940, expend
the balance remaining out of said revenues, including any
such revenues brought forward from the year ending June
30, 1939, for the purpose of making additions and better-

The Virginia Conservation Commission is hereby author-
ized, empowered and directed to erect, or cause to be erected,
upon that tract of land located in Prince William County
and known as the “Henry Farm,” upon which the First and
Second Battles of Manassas, or Bull Run were fought and
upon which General Thomas J. Jackson received the immortal
name of “Stonewall,” a suitable equestrian statue ort inomas
J. Jackson (“Stonewall” Jackson) and his horse, “Old Sorrell.”

tion, or any part thereof, at the disposal of the United States
of America, or the officers or agents duly authorized to act
for the United States of America, for the acquisition of said
lands for the establishment of the proposed George Washington
Memorial Parkway.
It is further provided, however, that this appropriation
shall be expended or placed at the disposal of the United States
of America or its duly authorized officers or agents for the ac-
quisition of said lands only when satisfactory proof is furnished
the Governor that an equivalent sum has been provided for the
same purpose by the political subdivisions adjacent to the pro-
posed George Washington Memorial Parkway; and provided
further that this appropriation is not to be considered as ob-
ligating the State to make further appropriations for the estab-
ishment of the aforesaid Parkway except as future general
issemblies may deem it wise to do so.

shall be available for expenditure only to the extent that the Governor
certifies, to the Comptroller in writing that such expenditure will not, in hi:
judgment, create or add to a deficit in the general fund of the treasury, dur
ing the biennium which ends June 30, 1940.
4. The compensation of each officer and employee who enters the ser
vice of the Commonwealth of Virginia during the period which begins Jul:
1, 1938, and ends June 30, 1940, shall be fixed for the said biennium at suc!
rate as shall be approved by the Governor in writing and no increase shal
be made in the compensation of any officer or employee of the State govern
ment during the said biennium except with the Governor’s written approva
first obtained. Where any officer or employee is appointed or employed t
fill a vacancy in a position for which a salary is fixed by this act the Gov
ernor may fix the salary of such officer or employee, who enters the servic
of the Commonwealth, or is promoted to such position, during the perio
which begins July 1, 1938, and ends June 30, 1940, at a lower rate or amoun
than is herein specified for such office or position. It is provided, howeve!
that this section shall not apply to any employee whose salary or wag
amounts to an annual rate of not exceeding $1,000.00.
For his assistance in carrying out the provisions of this section the Gov-
ernor may require information in writing from the head of any department,
institution or agency of the State government or from any employee thereof,
upon any subject relating to the duties of any office or position in such depart-
ment, institution or agency.
5. The appropriations provided for in this act for making loans to stu-
dents at the several State institutions shall be expended upon such terms and
according to such rules as may be prescribed by the respective governing
boards of the institutions for which the appropriations are made, in making
loans to needy and deserving students of talent and character from Virginia
in said institutions for the purpose of aiding these to obtain an education at
such institutions, who might not be able otherwise to do so. Such loans shall
not exceed $200.00 in any one session to the same student; and they shall be
made to said students upon such terms, as to time and security, as the Comp-
troller shall prescribe; provided, however, that the rate of interest charged
said students on such loans shall not be less than four per centum per annum.
The said State students’ loan funds shall be preserved from depletion by
the said institutions; and together with the repayments and accretions thereto,
shall be held and used for the purpose specified in this act and no other; and
each of the said institutions shall annually, not later than July in each year
thereafter, file, in the office of the superintendent of public instruction, a state-
ment, in detail, showing for the year past the amounts received by said funds,
or the loans made, to whom made, and upon what terms, the amount of the
corpus of said funds, the amounts repaid to said funds, and from whom,.and
any other information deemed pertinent by the institution so reporting, or
which may have been requested by the superintendent of public instruction, it
is provided, however, that nothing herein contained shall prohibit the pay-
ment out of said State students’ loan funds of any expenditure necessarily
incurred and reasonable in amount in collecting or undertaking to collect any
such students’ loan.
The comptroller shall make no payment to any of the said institutions on
account of the said students’ loan funds unless and until the institutions apply-
ing for such payment shall have furnished the said comptroller a certificate
from the superintendent of public instruction that such institution has com-
plied, in all respects, with the foregoing requirements of this act in relation
thereto.
The Auditor of Public Accounts shall annually audit and exhibit in his
annual report the account of the said funds at each of the said institutions.
Where the student !oan fund created by State appropriation is inadequate
in amount at any institution to carry out fully the purpose for which this fund
was established, the governing board and president of such institution, with the
written consent and approval of the Governor first obtained, is authorized, for
the purpose of providing an additional student loan fund, to borrow from such
sources and on such terms as may be approved by the Governor an amount not
to exceed $20,000, and to provide for such extensions or renewals of such
loans as may be necessary. Such fund shall be used only in making loans to
students in the same circumstances and under the same terms and regulations,
as are herein prescribed for loans from the fund created by the State appropria-
tion, and for no other purpose whatever. The repayments and interest ac-
cretions to said fund shall be used so far as may be necessary to repay the
indebtedness of the institution created by the governing board and presiding
officer thereof, in establishing said additional student loan fund. Such ad-
ditional amounts may be borrowed by the governing board and president o!
the institution, with the Governor’s approval, from time to time, as may be
necessary to maintain the amount of said additional loan fund, whether in
cash or notes receivable or both, including all amounts heretofore borrowed
and not repaid, at $20,000.
Accounts shall be kept and reports rendered for all such additional loan
funds in all respects as herein required for loan funds created by State appro-
priation, and the Auditor of Public Accounts shall anually exhibit in his re-
port the amounts of the said additional loan funds at each institution.
It is hereby provided that the governing board of any State institution for
which a Student Loan Fund has been established may, with the written
approval of the Governor, cancel any indebtedness due such institution on
account of a loan or loans made from such fund when such indebtedness has
been outstanding more than fifteen years, and in the opinion of the president
and governing board of the institution is uncollectible. Upon the cancellation
of any such indebtedness a statement thereof describing the obligation in
detail and the date of its cancellation shall be certified by the President of the
institution to the Comptroller.
7. All of the taxes upon inheritances hereafter collected, regardless of
the date of the death of the decedent, shall, when collected, be paid promptly
and directly into the general fund of the State treasury.
8. All monies hereafter paid into the State treasury by or on behalf of
any county, city or other political subdivision of this State, by way of reim-
bursement, or partial reimbursement, to the State, as required by law, for the
cost of any audit or examination of the books and records of any such political
subdivision, or of any officer or agency of any such political subdivision, made
by the Auditor of Public Accounts in pursuance of law, shall be paid into the
general fund of the State treasury; and any unexpended balance existing on
the date this act takes effect in any special fund or special funds, heretofore
derived in the manner as aforesaid, shall on such date be converted into the
general fund of the State treasury.
9. All monies, fees, taxes and other charges hereafter collected by or on
behalf or on account of the dairy and food division of the department of agri-
culture and immigration in pursuance of law, from whatever source, or on
account of the laws administered by the said division or the said department,
shall be paid promptly and directly into the general fund of the State treasury.
This paragraph includes the fund known as the dairy and food inspection fund
and the fund known as the sale of reacting animals fund.
10. All monies, fees, taxes and other charges hereafter collected by or on
behalf or on account of the division of markets of the department of agricul-
ture and immigration for the voluntary inspection of agricultural and other
products or commodities and for the inspection of herring and for the cer-
tification of the grade classification, quality and condition thereof, shall be paid
promptly and directly into the general fund of the State treasury.
11. All fees and other charges hereafter collected by or on behalf or on
account of the State Corporation Commission, or any division or bureau there-
of, in pursuance of law, for the examination and supervision of banks, trust
companies, industrial loan banks, small loan companies, credit unions and
building and loan associations, and for regulating the sale of securities, shall
be paid promptly and directly into the general fund of the State treasury.
The Governor is hereby authorized, in his discretion, to increase the annual
appropriation to the State Corporation Commission, made by this act for the
supervision, regulation, restriction, and control of the issuance of securities,
provided, however, that the appropriation shall not exceed the sum collected
from filing and license fees under this act.
With the written consent and approval of the Governor first obtained, the
State Corporation Commission may spend, in addition to the appropriations
herein made, for the supervision, inspection and regulation of concerns con-
ducting an insurance business, any additional revenues paid into the State
treasury from fees or other charges for the supervision, inspection and regula-
tion of concerns doing an insurance business.
The Governor is authorized in his discretion to increase the annual appro-
priation to the State Corporation Commission for the supervision, regulation,
etc., of the issuance and/or sale of securities to an amount not to exceed
the sum collected from filing and license fees under any law providing for
the supervision and regulation by the commission of the issuance and/or sale
of securities.
12. All penalties imposed by sections 8, 9, 10 and 11 of the tax bill, as
amended, for failure to comply with the provisions thereof, and all sums re-
ceived in pursuance of offers in compromise of prosecution for violation of the
tax laws shall be hereafter paid into the general fund of the State treasury,
and the special or separate fund created by subsection 4 of section 11 of the
tax bill, as amended by an act approved March 31, 1926, for expenditure by
the State Tax Commission and its successor, is hereby abolished.
13. All monies, fees, taxes and other charges hereafter collected by or on
behalf or on account of the Department of Agriculture and Immigration, in
pursuance of law, from whatever source, or on account of the laws adminis-
tered by the said department, or any division or section thereof, shall be paid
promptly and directly into the general fund of the State treasury. This para-
graph includes the fund known as the hog cholera serum fund, the fund knowr
as the fertilizer fund, the fund derived from the registration and certificatior
of nurseries, the funds derived from the licensing and inspection of creameries
cheese plants, condensed milk plants, ice cream plants, milk distributing plant:
and milk and ice cream buying stations, and such other special funds as are
hereinbefore described, but does not include the funds derived from the opera:
tion of the State lime grinding plants.
14. All fees hereafter collected for the examination and licensing of mo.
tion picture films publicly exhibited in Virginia, together with all other receipt:
from all sources collected for the support of the division of motion picturé
censorship, shall be paid directly and promptly into the general fund of the
State treasury.
15. All fees and charges collected by or on behalf of the Virginia rea
estate commission for licensing and regulating real estate brokers and real
estate salesmen, in accordance with the provisions of chapter 461 of the acts o!
assembly of 1924, or any amendment thereto, shall be paid promptly and di-
rectly into the general fund of the State treasury.
16. It is hereby provided that the military fund be, and the same is
hereby, abolished, and monies shall no longer be set aside by the comptroller
for the said fund.
17. All revenues and funds heretofore accumulated or hereafter collected
under the provisions of section 15 of an act approved March 30, 1936 (Acts
of Assembly, 1936, page 775), shall be paid directly and promptly into the
general fund of the State treasury.
18. All monies, fees and revenues heretofore accumulated, or hereafter
collected by the State Commission on Conservation and Development by,
from, or through the operation of State parks, including entrance and con-
cession fees and any and all other funds derived from the Operation or use
of such parks, shall be paid directly and promptly into the general fund of
the State treasury.
19. All fees hereafter received or collected by or on behalf of the State
Registrar of Vital Statistics under the provisions of chapter 371 of the acts
of assembly of 1924, or any amendment thereto, shall be paid directly and
promptly into the general fund of the State treasury.
20. All revenues hereafter collected from the license tax imposed on
pistols and revolvers under the provisions of chapter 158 of the acts of assem-
bly of 1926, shall be paid directly and promptly into the general fund of the
State treasury and shall be subject to appropriation to the same extent and
for the same purposes as other general fund revenues.
The Department of Taxation is hereby authorized to require commissioners
of the revenue to aid in the administration of the revenue-raising provisions of
the said chapter 158 of the acts of 1926 and may allow a fee of ten cents to
each commissioner of the revenue for each pistol or revolver license issued
as the result of work done by such commissioner of the revenue. Such fees so
allowed shall be paid to the commissioner of the revenue entitled thereto upon
warrants of the Comptroller issued on certificates signed by the State Tax
Commissioner.
21. All monies, fees, taxes and charges hereafter collected by the State
board for the examination and certification of architects, professional en-
gineers and land surveyors, as authorized by chapter 328 of the acts of assem-
bly of 1920, as amended, shall be paid directly and promptly into the general
fund of the State treasury.
22. All monies, fees, taxes and charges hereafter collected by the State
Board of Accountancy, as authorized under sections 566 to 571, inclusive, of
the Code of Virginia of 1919, as amended, shall be paid directly and promptly
into the general fund of the State treasury.
23. All monies, fees, taxes and charges hereafter collected by the State
Board of Dental Examiners, as authorized under sections 1640 to 1654, in-
clusive, of the Code of Virginia of 1919, as amended, shall be paid directly and
promptly into the general fund of the State treasury.
24, All monies, fees, taxes and charges hereafter collected by the State
Board of Embalmers and Funeral Directors of Virginia, as authorized under
sections 1715 to 1722, inclusive, of the Code of Virginia, or any amendment
thereto, shall be paid directly and promptly into the general fund of the
State treasury. ‘
25. All monies, fees, taxes and charges hereafter collected by the State
Board of Examiners in Optometry, as authorized under sections 1625 to 1632,
inclusive, of the Code of Virginia of 1919, or any amendments thereto, shall be
paid directly and promptly into the general fund of the State treasury.
26. All monies, fees, taxes and charges hereafter collected by the State
Board of Examiners of Graduate Nurses, as authorized under sections 1703 to
1714, inclusive, of the Code of Virginia of 1919, as amended, shall be paid di-
rectly and promptly into the general fund of the State treasury.
27. All fees and other revenues segregated to the library fund, in accord-
ance with section 349 of the Code of Virginia (1919), and all other fees and
revenues hereafter collected by the Virginia State Library, shall be paid into
the general fund of the State treasury, and the said library fund is hereby
abolished.
28. All monies, fees, taxes and charges hereafter collected by the State
Board of Veterinary Examiners, as authorized under sections 1272 to 1278, in-
clusive, of the Code of Virginia of 1919, shall be paid directly and promptly
into the general fund of the State treasury.
29. All monies, fees, taxes and charges hereafter collected from the tax or
fee of five cents per gallon scallop label sales levied under chapter 95 of the
acts of assembly of 1930 shall be paid directly and promptly into the general
fund of the State treasury.
30. All monies, fees, taxes and charges hereafter collected by the board
for the examination of applicants for admission to the bar as authorized under
sections 3410 to 3418, inclusive, of the Code of Virginia of 1919, as amended,
shall be paid directly and promptly into the general fund of the State treasury.
31. All fees hereafter collected by the Board of Commissioners to Ex-
amine Pilots under the provisions of section 3615 of the Code of Virginia of
1919 as amended, shall be paid promptly and directly into the general fund of
the treasury without any deductions on account of salaries, fees, costs, charges,
expenses, refunds or claims of any description whatever.
32. All monies, fees and revenues which are required by law to be paid
into the State treasury when collected by either or any of the following institu-
tions and agencies, to-wit:

Virginia Truck Experiment Station
Central State Hospital
Petersburg State Colony
Eastern State Hospital
Southwestern State Hospital

Southampton Penitentiary Farm
Virginia Industrial School for Boys
Virginia Home and Industrial School for Girls
Virginia Industrial School for Colored Girls
Virginia Manual Labor School for Colored Boys
shall, on and after July 1, 1938, when collected py any of said institutions or
agencies, be paid promptly into the general fund of the State treasury.
It is provided, however, that the provisions of this section shall not apply
to the DeJarnette State Sanatorium, nor to the Industrial Department of the
Penitentiary.
34. The appropriation in this act of a specific amount for the examina-
tion of the accounts of local governmental units shall not be construed as pro-
hibiting the examination or audit, by the Auditor of Public Accounts, of the
books or records of any county, city or other political subdivision, or any
officer or agency thereof, of this State, the cost of which audit or examination,
is required by existing laws to be borne by the said county, city or other
political subdivision, and the Auditor of Public Accounts is hereby authorized,
with the written consent and approval of the Governor first obtained, to make
such expenditures, in addition to the specific appropriation made in this act
for the examination of the accounts of local governmental units, as may be
necessary to give effect to this provision.
35. With the written consent and approval of the Governor first ob-
tained, any department, institution or other agency of the State government
may expend, in addition to the appropriation herein made to such department
institution or agency, any money, revenue or funds paid into the State treas-
ury to the credit of said department, institution or agency, in excess of suck
appropriations as proceeds of donations, gifts or Federal grants, when late
developments are believed to make such expenditure necessary, such expendi.
ture to be in accordance with the purpose for which said gift, grant or dona.
tion was made.
36. Any amount paid to any department, institution or other agency o
the State government as proceeds of an insurance policy may be expended tc
replace any property loss covered by such policy and is hereby appropriated
for expenditure as far as may be necessary, to make such replacement pro
vided, however, that the Governor’s written approval shall first be obtainec
for any such expenditure of the proceeds of an insurance policy in excess o
$2,500.00.
37. It is hereby provided that no public funds or money shall be ex
pended by any State institution of higher learning to which an appropriation
is made by this act, for the purpose of paying for advertisements or advertis-
ing intended or designed to promote student attendance at any such in-
stitution.
38. No State institution of higher learning shall hereafter undertake or
engage in the operation of any new or additional extension school, day school!
or junior college, or in the teaching of any new or additional courses of study
or extension courses, unless the written approval of the State Board of Educa-
tion and of the Governor be first obtained.
39. Every appropriation set forth in the foregoing provisions of this
act for any State institution and made payable from the general fund of the
State treasury is to supplement revenues earned and collected by such in-
stitution and shall be paid from the general fund of the State treasury only
insofar as shall be necessary to provide for the maintenance and operation of
such institution; each such appropriation shall be reduced by the Governor
insofar as the same is not so required.
40. No expenditures for printing, ruling, lithographing and _ binding
annual reports or for printing, ruling, lithographing and binding any other
publications, forms or material of any description for the Division of Motor
Vehicles, the Industrial Commission, the Unemployment Compensation Com-
mission of Virginia, the Virginia Alcoholic Beverage Control Board, the State
Wrestling and Boxing Commission, the Milk Commission, the Commission of
Fisheries, the Commission of Game and Inland Fisheries or the State High-
way Commission shall be paid out of the appropriations made to the Division
of Purchase and Printing. All expenditures incurred or made by any of the
aforesaid departments or agencies for printing, ruling, lithographing and bind-
ing of any description shall be paid by the department or agency for which
such printing, ruling, lithographing and binding is done out of the appro-
priation made to said department or agency and shall not be paid out of
the general fund of the State treasury nor out of any appropriation payable
therefrom.
_ 41. Before distributing to the counties and cities of the State the
amounts received into the treasury from collections of State capitation taxes,
the comptroller shall deduct from the amounts returnable to the counties and
cities a sum equal to five per centum of the amount of State capitation taxes
collected and credit the amount to the general fund of the Commonwealth to
reimburse that fund for the expenses paid therefrom incident to the assess-
ment and collection of said capitation taxes.
42. It is further provided that from the revenues collected and paid into
the treasury, by county and city treasurers, clerks of courts and delinquent
tax collectors, or, other collecting officers, creditable to any fund or funds
other than the general fund of the Commonwealth, the cost of collecting
which has been paid from an appropriation out of the general fund of the
Commonwealth, the Comptroller shall deduct the amount of cost of such
collections and credit the same to the general fund of the Commonwealth to
reimburse that fund for the expense paid therefram.
43, The Virginia School for the Deaf and the Blind at Staunton, shall
reimburse monthly the Western State Hospital, at Staunton, for steam fur-
nished the said School for the Deaf and the Blind by the said Western State
Hospital at a rate per thousand pounds of steam so furnished, to be fixed by
the Director of the Division of the Budget with the approval of the Gov-
ernor. Such rate shall include the actual cost of the production of such steam,
by the Western State Hospital, as determined by the supervisor of State
power plants, including in the said production cost all operating expenses,
depreciation on heating plant buildings and equipment and interest on the
amount invested therein. The amount received by the Western State Hos-
pital from the said Virginia School for the Deaf and the Blind, under this
section, shall be credited by the Comptroller to the appropriation for the
Western State Hospital as a refund on the cost of fuel purchased by the said
hospital.
44. The Comptroller is hereby directed to transfer to the general fund
of the State treasury for each fiscal year of the biennium which begins July
1, 1938, and ends June 30, 1940, from the respective appropriations made by
this act, to the Bureau of Insurance and Banking for the supervision and
inspection of concerns conducting an insurance business in Virginia, to the
Industrial Commission of Virginia and to the Commission of Game and
Inland Fisheries, an amount equivalent to the annual rental payment obtained
by charging each of the said departments or agencies for the average amount
of floor space which they occupy during each of said years in buildings in
the Capitol Square at Richmond, at the annual rate of $1.75 per square foot
for office floor space and fifty cents per square foot for storage floor space;
provided, however, that the rate for office space occupied by the Commission
of Game and Inland Fisheries in the basement of the State Library Building
shall be seventy-five cents per square foot.
It shall be the duty of the Director of the Division of Grounds and
Buildings to report to the Comptroller on June 30th and December 3lst in
each of said fiscal years the average number of square feet of office floor
space and storage floor space occupied by each of said departments or
agencies during the respective six months ending on the aforesaid dates and
the Comptroller shall thereupon determine and transfer to the general fund of
the treasury, from the respective appropriations made to the said departments
or agencies, the amount due by each such department or agency for said
period of six months as rental for space so occupied in the buildings in the
Capitol Square, on the basis aforesaid; provided, however, that no rental shall
be charged for the space occupied by the Bureau of Insurance and Banking
for the purpose of making examinations of banks and small loan companies.
45. In order to reimburse the general fund of the State treasury for
expenses herein authorized to be paid from said general fund on account of
the administration of the Alcoholic Beverage Control Act, namely:

cordance with the provisions of section 17 of the aforesaid Alcoholic Beverage
Control Act, for the administration of said act, to the general fund of the
State treasury on January 1, 1939, and the sum of $25,000 shall be transferred
from the said special fund to the said general fund of the State treasury on
January 1, 1940.
46. In order to reimburse the general fund of the State treasury for
expenditures herein authorized to be paid out of said general fund on account
of the State Highway Department, namely:

the sum of $237,620 shall be transferred from the proceeds of the motor
vehicle fuel tax to the general fund of the State treasury on January 1, 1939,
and the sum of $235,000 shall be transferred from the proceeds of the motor
vehicle fuel tax to the general fund of the State treasury on January 1, 1940.
47, Allowances out of any of the appropriations made in this act by any
and all of the State institutions, departments, bureau and agencies to any
of their officers and employees for expenses on account of the use by such
officers and employees of their personal automobiles in the discharge of their
official duties shall not exceed five cents per mile of actual travel.
48. Travel, whether by common carrier, or privately owned or for hire
conveyance, shall be over the most direct practicable route and allowances
for travel, except as authorized by the next preceding section, shall not be
certified to the Comptroller for payment by agencies of government for
amounts exceeding the standard common carrier rates between points traveled,
except in an emergency (which emergency shall be stated in the expense
account), or, when, in the interest of the State, a greater expense is justified,
the facts in each such instance to be stated in the expense account.
49. All travel expense accounts shall be submitted on forms prescribed
or approved by the Comptroller. Each account shall show the dates expenses
were incurred or paid; points between which traveled: number of miles
traveled; method of travel, whether by railroad, steamship, bus, or, for hire,
privately owned or State owned automobile; pullman fare, to be shown sep-
arate from regular fare; hotel expense; meals; incidental expense, such as
telegrams, telephone calls, etc., to be specified in each instance; a concise state-
ment of the purpose of or reason for such travel expense. The Comptroller
is specifically directed to withhold the issuance of warrants in payment of
expense accounts submitted for “lump sum” amounts.
49-2. No automobile of the pleasure type shall be purchased by the
State or any officer or employee on behalf of the State costing more than
one thousand ($1,000.00) dollars without the written approval of the Gover-
nor first obtained. This provision, however, shall not apply to automobiles
purchased by or for the use of the Governor of Virginia.
50. All public revenues received into the State treasury within the two
appropriation years provided for in this act (with the exception of the rev-
enues segregated by law to special purposes), and the balance of the ap-
propriations payable out of the general fund of the State treasury, made by
previous acts of the General Assembly unexpended at the close of business
on the thirtieth day of June, 1938, which unexpended balances, except as
herein otherwise provided, are hereby declared to be lapsed into the State
treasury, are hereby designated the general fund of the State treasury of the
Commonwealth of Virginia, and shall be used for the payment of the ap-
propriations therefrom provided for in this act, subject to the limitations and
upon the conditions set out in this act.
51. No State department, institution or other agency receiving appropria-
tions under the provisions of this act shall exceed the amount of its appropria-
tions, except in an emergency, and then only with the consent and approval
of the Governor in writing first obtained; and if any such State department,
institution or other agency shall exceed the amount of its appropriation with-
out such consent and approval of the Governor, there shall be no reimburse-
ment of said excess, nor shall there be any liability or obligation upon the
State to make any appropriation hereafter to meet such deficit, and the mem-
bers of any governing board of any State department, institution or other
agency, or, if there be no governing board, the head of any State department,
institution or other agency, making any such excessive expenditures—in the
case of members of governing boards, who shall have voted therefor—shall
be personally liable for the full amount of such unauthorized deficit, and, in
the discretion of the Governor, shall be deemed guilty of neglect of official
duty, and be subject to removal therefor.
52. Any amount which a State department, institution or other State
agency may expend in excess of its appropriation, under authority given by
the Governor under this act to such department, institution or other State
agency to exceed its appropriation or to incur a deficit, shall be first obtained
by the said department, institution or agency by borrowing said amount on
such terms and from such sources as may be approved by the Governor
and the State Treasurer.
53. Subject to the qualifications in this section contained all appropria-
tions now or hereafter made payable out of the general fund of the State
treasury are hereby declared to be maximum, conditional and proportionate
appropriations, the purpose being to make the appropriations payable in full
in the amounts named herein if necessary and then only in the event the
aggregate revenues to be collected and available during the biennium for
which such appropriations are made, are estimated by the Governor to be
sufhcient to pay all of the appropriations in full; otherwise, the said
appropriations shall be deemed to be payable in such proportion as the
total sum of all appropriations out of the general fund of the treasury
bears to the total amount of general fund revenue estimated by the Governor
as available in the said biennium.
The Governor is hereby given the power ‘and authority to examine
and survey the progress of the collection of revenue applicable to the general
fund of the State treasury, out of which the appropriations made by this act
or by any other act are payable, and to declare and determine the amounts
that can during each quarter of each of the fiscal years of the biennium be
properly allocated to each respective general fund appropriation. In making
such examination and survey, he may require estimates of the prospective col-
lection of revenues from the Comptroller, the State Tax Commissioner, the
State Corporation Commission and any other revenue assessing or collecting
agency of the State having information which in the opinion of the Governor
may be pertinent. The Governor shall, subject to the qualifications herein
contained, reduce all of said appropriations payable out of the general fund
of the State treasury, made by this act or by any other act, pro rata when
necessary to prevent an overdraft or deficit for the biennium for which
such appropriations are made. Any such reduction so made shall be applied
to all fees, charges and commissions, including salaries and other allowances
to local officers and employees, the amount of which is fixed by or under
general law, paid out of the general fund.
However, in applying any such reduction to the appropriations payable
to sheriffs and city sergeants the cost of food and other articles necessarily
purchased by said sheriffs and city sergeants, in the performance of their
official duties for the State of Virginia, shall be excluded from the said
reduction.
In exercising the powers and performing the duties set forth in the
preceding paragraph, the Governor shall in no case reduce any appropriation
therein referred to to any amount less than ninety per centum of the original
appropriation.
This section shall not be construed as authorizing any reduction to be
made in the amounts herein appropriated for the payment of interest and
sinking fund installments on the bonded debt of the State government, or
for the payment of a legally authorized deficit, or for the payment of pen-
sions to Confederate veterans, their widows or dependents, or for the sup-
port of needy Confederate women, or Confederate veterans, or for caring for
the graves of Confederate dead, nor as authorizing a reduction in the salary
of any State officer where such reduction would be contrary to the Constitu-
tion of the State.
Where necessary to the exercise of the powers and duties conferred on
the Governor by this section, he may enforce such uniform reductions in the
salaries of State officials and employees on a flat or graduated basis as he
may find necessary, provided such reductions shall not exceed in any case
ten per centum, and provided, further, that any such salary reduction which
the Governor may order or require, shall apply to salaries payable from special
funds, as well as to salaries payable from the general fund of the treasury.
54. It shall not be lawful for the Comptroller to pay any State depart-
ment, institution or other agency any money, except as is provided for in this
act, or in pursuance of some act of the General Assembly making special
appropriations therefor.
55. The proper officer of each State department, institution or other
agency, for which appropriations are made, shall, in his annual report, give an
itemized account of all other sums received by such department, institution,
officer or other agency from any other source, and such reports and accounts
shall embrace the expenditure of all such funds; which reports shall be for-
warded to the General Assembly and laid before both houses at each session
thereof.
56. None of the monies mentioned in this act shall be expended for any
other purpose than those for which they are specifically appropriated, and it
shall be the duty of the Governor, as chief budget officer of the State, or his
deputy, to see that this provision is strictly observed; and should he find
that the said monies are not being expended in accordance with the provisions
of this act, cr that the expenditures under any appropriation included in this
act are in excess of the amount necessary to carry out the purpose for which
said appropriation was made, he is hereby given the power to restrain the
Comptroller from making further disbursements, in whole or in part, out of
said appropriations, to the offending State department, institution, officer or
other agency receiving appropriations under the provisions of this act, pro-
vided, however, that the several appropriations made by this act may not only
be used for the purposes specified in this act, but authority is hereby given to
the governing board of any State department, institution or other agency,
or, if there be no governing board, to the head of such department, institu-
tion or other agency named in this act, to transfer, within the respective
department, institution or other agency, any such appropriations from the
object for which specifically appropriated or set aside to some other object
deemed more necessary in view of later developments, subject, however, in
every case, to the consent and approval of the Governor, in writing, first
obtained; and provided, that the total amount appropriated to the respective
department, institution or other agency shall in no case be exceeded; and,
further provided, that should such appropriation be withheld by the Governor
from any State department, institution, officer, or other agency, named in this
act, or should transfers be authorized by the Governor, as herein provided,
a copy of the Governor’s order in each case setting forth the reasons for with-
holding said appropriations or for authorizing the transfer of said appropria-
tions, as the case may be, shall be preserved in the office of the Governor or
the Division of the Budget and kept open for public inspection.
It is further provided, however, that any State institution may, with th
written consent and approval of the Governor first obtained, spend, in addi
tion to the amount herein appropriated, out of the special revenues of suc]
institution, any additional special revenues paid into the State treasury te
the credit of such institution, where later developments are believed to mak.
such additional expenditure necessary.
57. No appropriation made by this act to any society, institution, board
association or agency not owned or controlled by the State of Virginia, shal
be expended except with the consent and approval of the head or governing
board of the State department or institution herein designated, to supervis«
said expenditures. The payrolls or bills presented to the Comptroller for saic
expenditures shall be itemized and classified, in accordance with the budge
classification adopted by the Governor, and shall be countersigned by the
head or executive officer of said State department or institution, designatec
for such purpose, and lump sum transfers of appropriations to the afore.
said agencies are hereby prohibited. It shall be the duty of each of saic
societies, institutions, boards, associations, and agencies to submit its biennia:
budget estimates to the head or executive officer of said State department or
institution, for examination and approval, who shall, after final examination
of said estimates, transmit the same to the Director of the Division of the
Budget, with such recommendations as may be considered necessary or
advisable. The accounts of each of the said societies, institutions, boards,
associations, and agencies shall be subject to audit by the Auditor of Public
Accounts, at the direction of the Governor.
It shall be the duty of the Comptroller to exercise, as herein required,
control and supervision over the expenditures and budget estimates of the
Confederate memorial associations.
It shall be the duty of the State Librarian to exercise, as herein required,
subject to the approval of the library board, control and supervision over the
expenditures and budget estimates of the Confederate museum at Richmond.
It shall be the duty of the Superintendent of Public Instruction to exer-
cise, as herein required, subject to the approval of the State Board of Educa-
tion, control and supervision over the expenditures and budget estimates of
the Cooperative Education Association, and the Virginia Branch of the
National Congress of Parents and Teachers and the Negro Organization
Society, Incorporated.
It shall be the duty of the Commissioner of Agriculture and Immigration
fo exercise, as herein required, subject to the approval of the State Board of
Agriculture and Immigration, control and supervision over the expenditures
and budget estimates of the Virginia State Fair Association and the Virginia
State Horticultural Society. :
It shall be the duty of the Director of the Extension Division of the
Virginia Agricultural and Mechanical College and Polytechnic Institute to
*xercise, as herein required, control and supervision over the expenditures
ind budget estimates of the Virginia Crop Improvement Association, the
Virginia State Dairymen’s Association, and the Virginia State Poultry Federa-
ion.
It shall be the duty of the Commissioner of Public Welfare to exercise,
as herein required, subject to the approval of the State Board of Public
Welfare, control and supervision over the expenditures and budget estimates
of the Home for Needy Confederate Women, the several travelers’ aid
societies receiving appropriations from the State of Virginia and the Virginia
Home for Incurables.
58. The State Hospital Board, created by an Act of the General Assem-
bly of Virginia, approved December 24, 1936, shall be subject to the provi-
sions of paragraph k of section 10 of chapter 79 of the Acts of Assembly of
1928 in the expenditure of any funds made available for the said State
Hospital Board and no expenditure out of any appropriation made to the said
Board or to any of the State Hospitals under the supervision, management
and control of the Board shall be made by the said Board until the said Board
shall submit to the Director of the Division of the Budget a quarterly estimate
of such expenditures and such estimate shall have been approved by the
Governor.
The governing board of the board of visitors of the Virginia Agricul-
tural and Mechanical College and Polytechnic Institute, at Blacksburg, is
hereby authorized, through the commissioners of the sinking fund, to issue
and sell certificates of indebtedness in the name and on behalf of the in-
stitution, to raise funds for the construction and equipment of dormitories
and dining halls, subject to the conditions and limitations hereinafter set
out. The amount of certificates of indebtedness which may be issued on be-
half of the said institution shall not exceed seven hundred and fifty thousand
dollars ($750,000.00). The certificates of indebtedness issued under the pro-
visions of this act shall be signed, on behalf of the institution by the presid-
ing officer of the governing board, and shall be countersigned by the State
Treasurer, who shall keep an account thereof in his office. The certificates of
indebtedness issued under this act are the certificates of the institution issuing
them and not the certificates of the State. The said certificates of indebted-
ness shall bear interest, payable semi-annually January first and July first
of each year, at the rate of four per centum per annum. The said certificates
shall be issued in such denominations and shall mature at such time or times,
not exceeding thirty-three years from their date, as may be prescribed by
the Governor. The loans made under this act, including interest thereon,
shall constitute a specific lien on the grounds, buildings and equipment oc-
cupied, used or pertaining to the dormitories and dining halls provided un-
der this act, and all such buildings and equipment shall be kept fully and
adequately insured for the benefit of the literary fund, or the other owner or
owners of such certificates, and the policy or policies of insurance shall be
kept on file in the office of the comptroller. The State Board of Education is
hereby authorized in its discretion subject to the approval of the Governor
to sell any bonds of the State held as a part of the literarv fund, and is au-
thorized in its discretion, subject to the approval of the Governor, to invest
the proceeds derived from the sale of such bonds in the certificates of in.
debtedness issued under the provisions of this act. The State Board o
Education is further authorized in its discretion, subject to the approval of
the Governor, to invest any uninvested portion of the literary fund in the cer-
tificates of indebtedness issued under the provisions of this act, and all such
certificates purchased with funds belonging to the literary fund shall become
the property of and a part of that fund. In the event that sufficient funds are
not available for the purchase of such certificates with money belonging to the
literary fund, or the proceeds arising from the sale of the bonds hereinabove
referred to, the commissioners of the sinking fund are directed, when and as
required by the Governor to do so, to sell the said certificates of indebted-
ness for cash at such prices, not less than par, as may be approved by the
Governor and said commissioners. The sum of money loaned from the
literary fund, as above provided, or received from the sale of certificates of
indebtedness, issued and sold under the provisions of this act, shall be paid
into the State treasury to the credit of said institution, and such amounts
so paid into the treasury to the credit of the institution are hereby appro-
priated to and may be expended by the board of visitors, for the construction,
completion, and equipment of dormitories and dining halls for the use of stu-
dents of the said institution and for no other purposes whatsoever, All pay-
ments out of the treasury shall be made upon order of the comptroller. In
order to provide for the payment of the interest and principal on the cer-
tiiicates issued under this act and the creation of a sinking fund to retire
them at maturity, the comptroller shall set aside quarterly to the credit of a
special account to be opened on the books of the comptroller for the said
institution, so much of the net rents, fees and charges received from students,
or other persons, for the use of the dormitories and dining halls constructed
with funds derived from the issuance of such certificates of indebtedness, and
paid into the State treasury, as may be necessary for said purpose. The term,
net rents, fees and charges, as herein used, shall be construed to mean the
gross rents, fees and charges received for the use of such dormitories and
dining halls, less the cost of operation and maintenance of such dormitories
and dining halls, including the insurance premiums. In the event that the
rents, fees and charges derived from the said dormitories and dining halls
are not sufficient to pay off the indebtedness of the said institution, when
and as required by this act, then the amount of such deficiency shall be set
aside by the comptroller out of the other revenues paid into the State treas-
ury by such institution on or before the due date of any installment of
principal or interest on such certificates. If at any time default shall be made
by the institution in the payment into the State treasury of the moneys here-
by required so to be paid in for interest, principal and sinking fund require-
ments, the commissioners of the sinking fund shall notify the comptroller
of this fact, and he is hereby authorized and directed to draw his warrant
upon the then current annual State appropriation to the institution for the
amount which is then due on account of interest and principal. Such war-
rants shall thereupon be honored and such amount disposed of in the same
manner as if it had been paid into the State treasury by the institution as
required by law. The moneys so received into the State treasury shall be
used by the commissioners of the sinking fund, first, to pay the interest
on such certificates of indebtedness, issued on behalf of the institution, when
and as it becomes due and payable, and the balance shall be used to pay the
principal thereof. All moneys disbursed by the commissioners of the sinking
fund shall be paid out of the State treasury on warrants of the comptroller
issued on the order of such commissioners. The purchasers of any of the
certificates of indebtedness issued under the provisions hereof shall not be
required to see to the application of the purchase money.
59. All the appropriations herein made out of the general fund of the
State treasury for the two years ending, respectively on June 30, 1939, and on
June 30, 1940, unexpended on the books of the Division of Accounts and
Control at the close of business on June 30, 1940, shall, except as herein
otherwise expressly provided, revert to and become a part of the general
fund of the State treasury of the Commonwealth of Virginia, and shall not
thereafter be paid by the Comptroller and the same shall be charged off upon
the books in his office, provided, however, that such unexpended balances
shall be continued in force for such period not to exceed ten days from June
30, 1940, as may be necessary in order to permit the payment of any claims,
demands or liabilities incurred prior to June 30, 1940, and unpaid at the close
of business on that date and shown by audit in the Division of Accounts
and Control to be a just and legal charge against any such unexpended
balance. In case the expenditures or indebtedness incurred at any institution
receiving funds under this act, shall exceed the amount appropriated without
legal authority, the Comptroller is hereby directed to make public such over-
draft, and the Director of the Budget is hereby directed to set out the same
in the next budget giving detailed information as to the obligations involved,
whether the overdraft be legal or not. Each and every public officer handling
any State funds shall, within thirty days after the State Corporation Commis-
sion calls for financial statements by State banks, make a detailed statement,
under oath, of the financial condition of his office as of the date of such call,
to the Auditor of Public Accounts, and upon such forms as shall be pre-
scribed by said Auditor of Public Accounts.
60. If any part or parts, section, sub-section, sentence, clause or phrase
of this act is for any reason declared unconstitutional, such decision shall not
affect the validity of the remaining portions of this act which shall remain in
force as if such act had been passed with the unconstitutional part or parts,
section, sub-section, sentence, clause or phrase thereof eliminated; and the
General Assembly hereby declares that it would have passed this act if such
unconstitutional part or parts, section, sub-section, sentence, clause or phrase
had not been included herein.
61. All acts and parts of acts inconsistent with the provisions of this
act be, and the same are hereby, repealed.
62. This act shall become effective on July 1, 1938.
