Chap. 255.—An ACT for the relief of J. Davenport Blackwell, trading as
Blackwell Engineering and Construction Company. [H B 391]

Whereas, on the tenth day of May, nineteen hundred and thirty-
five, J. Davenport Blackwell, trading as Blackwell Engineering and
Construction Company, of Warrenton, Virginia, entered into a con-
tract in writing with the College of William and Mary in Virginia,
for the construction of the amphitheatre, College of William and
Mary in Virginia, at Williamsburg, Virginia, part of the funds for
the construction of which were furnished to said college by the Federal
Emergency Administration of Public Works; and
Whereas, there was attached to said contract a scale of wages,
dated October first, nineteen hundred and thirty-four, sometimes called
the Governor’s scale of wages, a copy of which scale of wages was
delivered to said Blackwell to be used by him, and which was used
by him, in formulating the bid which was made by him and which
was accepted and formed the basis of the contract above mentioned
in which wage scale it was provided that carpenters on rough work
should be paid at the rate of eighty cents per hour and that carpenters’
apprentices and assistants should be paid sixty cents per hour; and
Whereas, the said Blackwell proceeded with his work on the basis
of said contract and the wage scale thereto attached for the weeks
ending May fifteenth and May twenty-second, nineteen hundred and
thirty-five, respectively, and he was then notified, because of action
taken by the Federal Board of Labor Review at Washington, that he
would be required, after the week ending May twenty-ninth, nineteen
hundred and thirty-five, to increase the scale of carpenters on rough
work from eighty cents to one dollar and ten cents per hour and for
carpenters’ apprentices and assistants from sixty cents to eighty cents
per hour; and
Whereas, said Blackwell was obliged to continue and finish the
work, and to pay such carpenters on rough work and carpenters’
apprentices and assistants respectively, at the rates of one dollar and
ten cents and eighty cents per hour, which he did under protest; as
a result of which increases, he was obliged to pay out and expend for
wages in finishing the work the sum of four thousand, two hundred
sixty-six dollars and ten cents in addition to what he would have
paid had he been allowed to proceed under the scale of wages at-
tached to this said contract; and he was also obliged to lay out
and expend, by reason of said increase in wages, on account of work-
men’s compensation, public liability, property damage insurance and
contractor's bond, the premiums on which were based on his payroll,
the sum of two hundred seventy dollars and seventy-seven cents, mak-
ing a total of four thousand, five hundred thirty-six dollars and eighty-
seven cents, which he is out of pocket by reason of said increases in
said wage scale which he was obliged to pay; and
Whereas, it seems proper that the Commonwealth of Virginia
should refund to the said Blackwell the said sum of four thousand
five hundred thirty-six dollars and eighty-seven cents, which he ha
been compelled to expend by reason of the increased wages he wa
required to pay in completing the said amphitheatre at the College o
William and Mary in Virginia, with interest from November first
nineteen hundred and thirty-five; now, therefore,
1. Be it enacted by the General Assembly of Virginia, there i:
hereby appropriated for the relief of J. Davenport Blackwell, trading
as Blackwell Engineering and Construction Company, the sum of fou
thousand five hundred thirty-six dollars and eighty-seven cents to be
paid out of any unexpended balance standing to the credit of the Col.
lege of William and Mary, in Virginia, at Williamsburg, on the book:
of the Division of Accounts and Control, at the close of business or
June thirtieth, nineteen hundred and thirty-eight, and if such balances
are inadequate for the payment of this appropriation in full the un-
paid balance shall be paid out of the amounts appropriated for main-
tenance and operation of the said College of William and Mary, in
Virginia, at Williamsburg for the year ending June thirtieth, nineteen
hundred and thirty-nine.
