Chap. 251.—An ACT to amend and re-enact Section 36 of Chapter 94 of the
Acts of the General Assembly of 1934, approved March 7, 1934, and known,
designated and cited as the Alcoholic Beverage Control Act, so as, among
other things, to provide what alcoholic beverages, materials and other articles
shall be deemed contraband and forfeited to the Commonwealth. [H B 313]

1. Be it enacted by the General Assembly ot Virginia, That sec-
tion thirty-six of chapter ninety-four of the Acts of the General
Assembly of nineteen hundred and thirty-four, approved March
seventh, nineteen hundred and thirty-four, and known, designated and
cited as the Alcoholic Beverage Control Act, be amended and re-
enacted so as to read as follows:
Section 36. What alcoholic beverages, materials and other articles
are contraband; forfeited to the Commonwealth.—All stills and dis-
tilling apparatus and material for the manufacture of same, and all
alcoholic beverages and materials used in the manufacture of alcoholic
beverages, and all containers in which alcoholic beverages may be
found, which are kept, stored, possessed, or in any manner used in
violation of the provisions of this act, and any firearm or weapon of
a like kind which may be used or which may be found upon the per-
son, or in any vehicle which such person is using to aid such person
in the unlawful manufacture, transportation or sale of alcoholic bev-
erages, or found in the possession of such person, shall be deemed con-
traband and shall be forfeited to the Commonwealth.
Such firearms or weapons of a like kind which shall be seized by
such officer shall be forfeited to the Commonwealth of Virginia upon
the conviction of the person or persons owning or possessing such wea-
pon or firearms and shall be sold by order of court and the proceeds
of such sale shall be paid into the Literary Fund.
2. An emergency existing, this act shall be in force from its
passage.
