Chap. 226.—An ACT to amend the Virginia Workmen’s Compensation Act, which
became a law March 21, 1918, by adding thereto a new section numbered
Section 52-a, providing for the voluntary retirement of members of the In-
dustrial Commission of Virginia and for the payment of retirement compen-
sation to persons who so retire, and appropriating funds therefor. B 90]

1. Be it enacted by the General Assembly of Virginia, That the
Virginia Workmen’s Compensation Act, which became a law March
twenty-first, nineteen hundred and eighteen, be amended by adding
thereto a new section numbered section fifty-two-a, which new section
shall read as follows:
Section 52-a. Any member of the Industrial Commission of Vir-
ginia may retire from the Commission at any time after having at-
tained the age of seventy years and after not less than ten consecu-
tive years of service as a member of the Commission, upon giving
the Governor notice in writing of his intention so to do, stating in
such notice the date upon which such retirement will become effective.
Upon receipt of such notice the Governor shall notify the Comptroller
of such retirement and the effective date of the same.
Any member of the Commission retiring under the provisions of
this section shall, after such retirement and for so long as he may live,
be paid by the State, annual compensation in an amount equal to
three-fourths of the annual salary being received by him immediately
prior to his retirement; such compensation shall be paid by the State
treasurer in monthly or semi-monthly installments, upon warrants of
the Comptroller, out of funds collected pursuant to the provisions of
this act, the Virginia Workmen’s Compensation Act, and paid into the
State treasury, for which purpose so much of such funds as shall be
required is hereby appropriated.
Provided, however, that any member of the Commission retiring
under the provisions of this act shall upon order of the Commission
hear and determine any cases which from time to time may be as-
signed to a retired member of the commission and such retired member
shall in the conduct of such hearings conform to the provisions of the
Virginia Workmen’s Compensation Act.
Vacancies caused by such retirements shall be filled in the manner
prescribed by law for filling vacancies otherwise occurring on the
Commission. But no vacancy shall be deemed to exist on the Com-
mission because of the death of any person in retirement pursuant to
the provisions of this section.
