Education, local school boards and division superintendents regarding tt
purchase and distribution of basal and supplementary textbooks for use ;

I. Be it enacted by the General Assembly of Virginia, That sec
tions six hundred and nineteen, six hundred and twenty, six hundre
and twenty-one, six hundred and twenty-two and six hundred an
twenty-three of the Code of Virginia, be amended and re-enacted ¢
as to read as follows:
Section 619. State Board of Education may Provide that Pub
lishers Sell Direct to Local School Boards; may Stipulate that Loca
School Board may Furnish Textbooks to Children Free or at Whole
sale Prices——The State Board of Education may provide in contrac
with publishers that said publishers shall sell direct to local schoo
boards at the wholesale price named in the contract and shal] requir
publishers to furnish an adequate supply of texts under the terms o.
the contract. The State Board of Education may also stipulate tha
the local school board may furnish said textbooks to the childrer
of the schools free or at the wholesale price at which books were
purchased, or at such other price not exceeding five per centum addec
to wholesale.
section 620. Textbook Requisitions by Division Superintendent
—On or before June twentieth of each year the division superintendent
shall make up a requisition covering all textbooks needed for the supply
of the schools at the opening of the following session. Such requi-
sition shall be based on detailed report from teachers or from any
other responsible source of information which may be used. Copies
of this requisition shall be sent to the State superintendent of public
struction.
Section 621. Local Board and Division Superintendent to see that
Textbook Orders are Forwarded to Publishers; Division Superinten-
lent to Report Departure from Contract Prices: Local Board to Sell
Textbooks in School Buildings.—The local board and the division
superintendent shall see to it that appropriate orders for books are
‘orwarded to each publisher directly from the local board not later
han June thirtieth of each year. If such orders are not promptly and
completely filled by publishers reports shall be made by the division
superintendent to the Superintendent of Public Instruction for inves-
igation and for report to the State Board of Education, if any action
inder the contract may be deemed proper. The division superin-
endent shall likewise report to the Superintendent of Public Instruc-
ion any irregularities or any failure of a publisher to comply with
he conditions of the contract with the State Board of Education,
he local board and the division superintendent shall provide an ade-
juate supply of basal and supplementary textbooks for sale directly
> the pupils in each public school building on the first day of each
egular school term or within five days thereafter. A reasonable supply
of such basal and supplementary textbooks shall be kept on hand for
resale directly to pupils in each consolidated, high or elementary school
with six or more teachers for a period of not less than ten days from
the date of the beginning of the school term or the date upon which
such supply is first provided.
Section 622. Central Depository may be Authorized by State
Board of Education; Orders——The State Board of Education may,
in its discretion, authorize a central depository to be operated under
the general control of the State Board of Education. In case such a
depository be established or maintained, then orders from local school
boards may be required to be filed with the depository rather than
with the publisher, but nothing in this section shall prohibit special
orders of books from being filled directly by the publishers.
Section 623. Division Superintendent not to Receive Compensa-
tion for Distributing Textbooks.—No compensation shall be allowed
to a division superintendent of schools who acts for the board in the
sale and distribution of school books.
Any violation of this section shall constitute a misdemeanor and
each separate act shall constitute a separate offense.
