Chap. 192.—-An ACT to amend and re-enact section 14 of an act entitled “An
~ act to provide a new charter for the city of Alexandria, Virginia’, approved
March 24, 1932, in relation to the election of certain city officers, so as to
provide for the election of the city attorney and the city collector by the
people and for the fixing of their compensation, and providing for a refer-
endum thereon. ] [H B 403]

1. Be it enacted by the General Assembly of Virginia, That sec-
tion fourteen of an act entitled an act to provide a new charter for
the city of Alexandria, Virginia, approved March twenty-fourth, nine-
teen hundred and thirty-two, be amended and re- “enacted so as to read’
as follows:. |
Section 14. The somal shall dort a city ft and a city auditor,
each of whom shall serve for such time as may be prescribed by the
council, and until his successor has been elected and qualified. |
Notwithstanding any provision of any other section or sections of
the charter of the city of Alexandria to the contrary, at the general
election to be held in said city on the Tuesday after the first Monday
in November, nineteen hundred and thirty- eight, there shall be elected
by the qualified voters of the city, a city attorney and a city collector,
whose terms of office shall begin on the first day of January, nineteen
hundred and thirty-nine and end on the thirty-first day of August,
nineteen hundred and forty; and at the regular municipal election to
be held in said city on the second Tuesday in June, nineteen hundred
and forty, and every three years thereafter, there shall be elected a
city attorney and a city collector for terms of three years beginning on
the first day of September next succeeding their election. Vacancies
occurring in the office of city attorney or city collector after January
first, nineteen hundred and thirty-nine, shall be filled under the pro-
visions of section sixteen of this charter. The terms of office of the
city attorney and city collector who shall hold said offices on December
thirty-first, nineteen hundred and thirty-eight, by appointment by the
city council, shall expire on that day, at midnight.
No person shall be eligible for election to the office of city at-
torney unless he shall be a duly licensed attorney at law and shall have
practiced in the State of Virginia for at least five years and in the
city of Alexandria for at least three years.
After December thirty-first, nineteen hundred and thirty- eight, the
entire compensation of the city attorney and the city collector shall
be by way of flat salaries, to be fixed by the council, provided that
the salary of the city attorney shall not be less than three thousand
dollars per annum and the salary of the city collector shall not be
less than twenty-four hundred dollars per annum.
2. The foregoing provisions of this act shall not become effec-
tive unless the same shall be approved by a majority of the qualified
voters of the city of Alexandria, voting on the question at the regular
municipal election in said city on the second Tuesday in June, nineteen
hundred and thirty-eight. It shall be the duty of the regular election
officers to prepare and have printed and distributed for use at said elec-
tion, in the manner prescribed by law for printing and distributing other
ballots, the requisite number of ballots for the submission of said
question, on which ballots shall be separately printed the two proposi-
tions, and immediately to the left of each, and on the same line there-
with, a square not less that one-quarter nor more than one-half. inch
in size, printed thus:
