Chap. 191.—An ACT to amend Chapter 94:of the Acts of the General As-
sembly of 1934, approved March 7, 1934, and known, designated and cited
as the Alcoholic Beverage Control Act, by adding thereto a new section,
numbered 4%, so as, among other things, to provide for allowances to wit-
nesses; and to prescribe how the same shall be paid. [fH B 361]

1. Be it enacted by the General Assembly of Virginia, That chap-
ter ninety-four of the Acts of the General Assembly of nineteen hun-
dred’ and thirty-four, approved March seventh, nineteen hundred and
thirty-four, known, designated and cited as The Alcoholic Beverage
Control Act, be amended by adding thereto a new section, numbered
section four and one-half, which new section shall read as follows:
Section 4%4. Allowances to witnesses; how and by whom paid.—
A person attending as a witness under a summons to testify before
the board in any hearing conducted by it, shall have fifty cents
($0.50) for each day’s attendance, and five cents ($0.05) per mile
for each mile beyond five (5) miles necessarily traveled to the place
of attendance, and the same for returning, besides the tolls at the
bridges and ferries which he crosses, or turnpike gates he may pass. _
The board shall, by order entered upon the records of its proceed-
ings, make all allowances to be paid for witness fees and mileage, and
when so allowed and certified by its secretary, or its acting secretary,
to the Comptroller, the last-named officer shall draw his warrant for
the payment of the amount of any such allowances by the State Treas-
urer from the same funds and in the same manner as all other operating
expenses of the board are paid; but the board shall not allow -any
witness fees or mileage to be paid out of the treasury save when
witness attendance or the service of process is at the instance of the
board. , , :
2. An emergency existing, this act shall be in force from its
passage. a
