Chap. 178.—An ACT to amend and re-enact Section 23 of Chapter 15 of the
Acts of the General Assembly of 1936, approved February 14, 1936, and
known, designated and cited as The Alcoholic Beverage Control Act, so as,
among other things, to provide a separate license for each separate place of
business; when transfer allowed; and requiring that such license be kept
posted. [H B 360]

1. Be it enacted by the General Assembly of Virginia, That section
twenty-three of chapter fifteen of the acts of the General Assembly of
nineteen hundred and thirty-six, known, designated and cited as The
Alcoholic Beverage Control Act, be amended and re-enacted so as to
read as follows:
Section 23. Separate license for each separate place of business;
when transfer allowed; to be kept posted—(a) Each license issued
by the board under the provisions of this act shall designate the place
where the business of the licensee will be carried on. A separate
license shall be required for each separate place of business.
(b) No such license shall be transferable from one person to
another, but may be amended to show a change in the place of busi-
ness from one point in the State of Virginia to any other point in the
State of Virginia where the privileges of such license may be lawfully
exercised, provided, however, that where such amendment is requested
showing a change of place of business that is not within the same
county or city in which the license was previously issued, notice of
intention to apply for such transfer shall be published in the same
manner as is now required by section nineteen of this act.
(c) Each such license shall be kept posted in a conspicuous place
oy the licensee at the place where he carries on the business for which
he license is issued.
(d) All licenses heretofore or hereafter granted or issued pur-
suant to the provisions of the Alcoholic Beverage Control Act or acts
umendatory thereof, except banquet licenses, shall expire on the thirtieth
lay of June next following the date on which they are granted or
ssued. The board may, however, within its discretion, extend any
license issued or granted hereunder, for a period not to exceed in any
case sixty (60) days.
(e) Subsections (a) and (c) hereof shall not apply to common
carriers operating dining cars, buffet cars and club cars.
2. An emergency existing, this act shall be in force from its pas-
sage.
