Chap. 433.—An ACT to authorize the State Commission on Conservation and
Development to transfer and convey to the United States of America, or a
department, institution or agency thereof, subject to certain conditions, re-
strictions and reservations, all rights, title and interest which the said com-
mission and the State of Virginia has or may hereafter acquire in and to
certain lands in Princess Anne county known and designated as the Virginia
Sea Shore State Park. {[H B 449]

1. Be it enacted by the General Assembly of Virginia, as follows:
Section 1. The State Commission on Conservation and Develop-
ment is hereby authorized and empowered, subject to the further provi-
sions of this act, to transfer and convey to the United States of
America, or such department, institution or agency thereof as may be
authorized to accept and provide for the preservation of the same, by
deed signed and executed by the chairman and executive secretary of
the said Commission, any and all right, title and interest which the
said State Commission on Conservation and Development and the State
of Virginia has or may hereafter acquire in and to the real estate, or
any part thereof, together with any improvements thereon, known
and designated as the Virginia Sea Shore State Park, lying and being
in Princess Anne county, Virginia, at or near Cape Henry in said
county and sometimes known as Cape Henry Desert, which said real
estate was conveyed to the said Commission by Cape Henry Syndicate,
a Virginia corporation, by its two deeds, both dated August eighth,
nineteen hundred and thirty-three and duly recorded on August eight-
eenth, nineteen hundred and thirty-three, in the clerk’s office of the
circuit court of Princess Anne county, Virginia, one in deed book one
hundred and seventy-two at page four hundred and thirty-five and the
other in deed book one hundred and seventy-two at page four hundred
and thirty-seven.
Section 2. Any transfer or conveyance of such land or any part
thereof by the State Commission on Conservation and Development
under the authority of this act shall be made subject to the condi-
tions, restrictions and reservations contained in section nineteen-a of
the Code of Virginia.
Section 3. No such transfers or conveyance shall be made except
and until the United States of America, or a department, institution
or agency thereof, acting under proper authority, shall desire and re-
quest such conveyance for the purpose of establishing and maintaining
a national park, either as a part of the Colonial National Monument
or otherwise.
Section 4. In the event that the United States of America, or the
department, institution or agency thereof to which such transfer and
conveyance is made, shall fail or refuse to maintain such lands as a
national park, then the title thereto shall immediately revert to the
State Commission on Conservation and Development, to be held in
trust for the State of Virginia.
