CHAP. 368.—An ACT to amend and re-enact Section 31 of chapter 247, Acts 1930,
relating to permits. [H B 208]

1. Be it enacted by the General Assembly of Virginia, That sec-
tion thirty-one of chapter two hundred and forty-seven, acts nine-
teen hundred and thirty, be, and the same is hereby, amended and
re-enacted so as to read as follows:
Section 31. Unlawful_to deal in furs without a permit——It shall
be unlawful-to buy,/sell}(barteryexchange) traffic or (trade in,) hargain
for, Solicit for pufcliasé, ‘or possess the hides, furs “or pelts of wild
animals, or otherwise deal in fur as a business, without having first
obtained a permit, subject to the following exemptions:
(1) Permit shall not be required of any hunter or trapper to dis-
pose of the hides, furs or pelts of wild animals legally shot or caught
by him.
(2) Permit shall not be required of any person lawfully engaging
in the business of fur farming to dispose of the hides, furs or pelts
of wild animals raised by him.
(a) Permit fees to buy furs at retail from trappers and hunters.—
The fee for a permit to buy hides, furs or pelts from individual trap-
pers or hunters by personal solicitation shall be as follows: County
resident, ten dollars; State resident, twenty-five dollars; county non-
resident, twenty-five dollars and State non-resident, seventy-five dol-
lars.
(b) Permit fees to buy at wholesale from retailers——The fee for
a permit to buy hides, furs or pelts at wholesale from retail fur deal-
ers or from fur farmers shall be as follows: State resident, five
dollars ; State non-resident, ten dollars.
The foregoing permits shall be issued in the name of the firm or
individual conducting the business, but shall authorize one person
only, who shall be designated as fur buyer, to personally solicit for
the purchase of furs within the area covered by the permit. Such
person may be the permittee, if an individual, a member of the firm,
or a bona fide employee of such individual or firm who is paid a
regular stated monthly salary.
(c) Fee to buy in a fixed place of business——The fee for a per-
mit to buy furs, hides or pelts from hunters or trappers at retail within
a fixed and established place of business; provided that no charge
for a permit shall be made to a licensed merchant doing business in
this State from a fixed location, shall be as follows: State resident,
five dollars ; non-resident, twenty-five dollars. .
All fur. permits shall be for the fiscal year, July first to June thir-
tieth, inclusive, and shall be obtained from the commission by making
written application. The qualifications obtaining for securing resident
county and State hunting and fishing licenses shall apply to obtaining
permits under this section and the commission may require affidavit
as to correctness of facts set forth on the application, Each permit
holder shall report to the commission at the end of each fiscal year,
or in ten days thereafter, the number of each species of hides, furs or
pelts bought and the total amount paid for each species during each
fiscal year and the total of all hides, furs or pelts bought and the
total amount paid therefor. The violation of any of the terms of this
section as to dealing in furs shall constitute a misdemeanor and sub-
ject the offender to a fine of not less than ten nor more than one
hundred dollars, or confinement in jail not exceeding six months, or
both, in the discretion of the court or jury trying the case. Further-
more, the trial court shall revoke the permit of the fur dealer and
he shall not have a similar permit for that season or for the succeed-
ing season, but may be eligible for a permit thereafter. Any furs
found in the possession of any person or firm acquired in violation of
this section shall be forfeited to the Commonwealth of Virginia, the
proceedings for such forfeiture to conform as far as practicable to
the provisions of chapter one hundred and thirty-one of the Code of
Virginia, and the net proceeds of said forfeiture to be paid into the
literary fund.
