CHAP. 327.—An ACT to amend and re-enact Section 47 of Chapter 242 of the
Acts of the General Assembly of 1932, approved March 26, 1932, which chapter
constitutes, and may be designated and cited as the Motor Vehicle Code of
Virginia, said section being in relation to taxing, driving or using a motor
vehicle without the owner’s consent, and prescribing penalites therefor.

1. Be it enacted by the General Assembly of Virginia, That section
forty-seven of chapter two hundred and forty-two of the Acts of the
General Assembly of nineteen hundred and thirty-two, approved
March twenty-sixth, nineteen hundred and thirty-two, which chapter
constitutes, and may be designated and cited as the Motor Vehicle
Code of Virginia, which section, as amended, shall read as follows:
Section 47. Any person who shall take, drive or use a motor
vehicle, trailer or semi-trailer not his own, without the consent of
the owner thereof and in the absence of the owner, and with intent
to temporarily deprive the owner thereof of his possession thereof,
without intent to steal the same, shall be guilty of a misdemeanor and
shall be punished by a fine of not less than ten dollars nor more than
five hundred dollars, or by imprisonment for not less than ten days
nor more than twelve months, either or both, in the discretion of the
court or jury trying the case. The consent of the owner of a motor
vehicle, trailer or semi-trailer to its taking, driving or using shall not
in any case be presumed or implied because of such owner’s consent
on a previous occasion to the taking, driving or using of such motor
vehicle, trailer or semi-trailer by the same or a different person.
Any person who assists in, or is a party or accessory to, or an accom-
plice in, any such unauthorized taking, driving or using, shall also be
guilty of a misdemeanor and shall be subject to the same punishment
as if he were the principal offender, as above provided.
