Chap. 324.—An ACT to amend the Code of Virginia by adding thereto a new
section numbered 2769, fixing the compensation and mileage of members of
boards of supervisors of counties, and to repeal Section 2769-a of the Code of
Virginia relating to similar matters. [S B 254]

1. Be it enacted by the General Assembly of Virginia, That the
Code of Virginia be amended by adding thereto a new section numbered
twenty-seven hundred and sixty-nine, which new section shall read as
follows:
Section 2769. Compensation of Supervisors——(a) Each member of
the board of supervisors of each county shall be allowed and paid out
of the county levy an annual salary, to be fixed as herein provided,
for his services in attending the meetings of the board and in dis-
charging the duties imposed by law upon him;
First. The total annual amount to be allowed as compensation for
the entire membership of the board of supervisors of each county shall
be fixed by the judge of the circuit court of such county, in term or
vacation, by an order entered by record in the common law order book,
within the following limits; in any county having a population of not
more than twenty thousand such total shall not exceed twelve hundred
dollars ; in each county having a population in excess of twenty thou-
sand but not more than twenty-six thousand such total shall not exceed
fifteen hundred dollars; in each county having a population in excess
of twenty-six thousand but not more than forty thousand such total
shall not exceed two thousand dollars; and in each county having a
population in excess of forty thousand such total shall not exceed
twenty-five hundred dollars, except that in counties in excess of fifty-
five thousand in population such salary shall not be less than twenty-
five hundred dollars. Provided, however, that counties having a popula-
tion of thirty thousand (30,000) inhabitants or more and which Board
of Supervisors of same has the duty of supervising the operation of
ferries owned in whole or in part by the said county, the compensation
of each member of the Board of Supervisors shall be not less than five
hundred ($500.00) dollars per annum for each member of said Board
and not more than eight hundred ($800.00) dollars per annum for each
member of said Board and the compensation shall be provided for in
accordance with the provisions of this section.
For the purposes of this section the population referred to shall
be that shown by the last preceding United States census.
Second. The annual compensation to be allowed each member of
the board of supervisors of any county shall be determined by dividing
the total amount allowed the entire board in accordance with the
provisions of the last preceding paragraph by the number of super-
visors in the said county. Provided, however, in any county that has
a density of population of more than fifty-three and less than fifty-
five inhabitants to the square mile within the geographical boundaries
of which is located a city on a navigable river having a population of
not less than ten thousand nor more than twenty thousand inhabitants
by the last United States census, the total annual amount to be allowed
as compensation for the entire membership of the board of supervisors
of such county shall be fixed in accordance with the terms of this act
at not more than two thousand dollars; and provided further that in
any county that has a population of not less than seven thousand in-
habitants and a density of population of not less than twenty-six per
square mile, in which county is located a port on a navigable river, the
total annual amount to be allowed as compensation for the entire mem-
bership of the board of supervisors of such county shall be fixed in
accordance with the provisions of this act at not more than twelve
hundred dollars.
(b) In addition to the foregoing compensation each member of the
board of supervisors shall be allowed and paid out of the county levy
five cents for each mile of travel required in going to and returning
from the place of meeting of the said board, provided that only one
mileage shall be allowed for each term or meeting of the said board,
and provided, further that mileage shall not be allowed for more than
twenty-four meetings in any year.
(c) Nothing in this section shall apply to any county which has
adopted or may hereafter adopt any form of county organization and
government provided for in sections twenty-seven hundred and seventy-
three-a to twenty-seven hundred and seventy-three-n, both inclusive, of
the Code of Virginia.
2. Be it further enacted by the General Assembly of Virginia, That
section twenty-seven hundred and sixty-nine-a of the Code of Virginia
be, and the same is hereby, repealed.
