Chap. 269.—An ACT to authorize and empower the county of Henrico in this
Commonwealth to acquire by purchase lands situate in said county for the
purpose of establishing and maintaining an airport, or aviation landing field,
and to establish, construct, improve, equip, maintain, and operate said air-
port or landing field, and to authorize the lease by the said county of the
whole or portions thereof, to individuals or corporations, for the operation of
the same, or any part thereof, on such terms and subject to such conditions
as may be provided by the board of supervisors of said county; to authorize
the lease of the whole or a part thereof to the government of the United
States upon a nominal or other rental, or without consideration, for aviation,
mail delivery, or other aviation purposes. {[H B 290]

1. Be it enacted by the General Assembly of Virginia, That the
county of Henrico is hereby authorized and empowered to acquire,
establish, construct, own, control, lease, equip, improve, maintain, and
operate an airport in said county, and may use for such purpose, or
purposes, any property suitable therefor, that is now, or at any time
may hereafter be owned, or controlled by said county, provided said
county shall not operate any such airport without the permission of
the State Corporation Commission first had and obtained.
2. That any lands acquired, owned, controlled, or occupied by said
county, for the purposes enumerated in section one hereof, shall and
are hereby declared to be acquired, owned, controlled and occupied
for a public purpose as a matter of public necessity, so long as the
same shall be used as an airport, an aviation or landing field by the
county or its lessee.
3. That the board of supervisors of said county, upon establishing
an airport or landing field and setting apart property for such pur-
pose, may construct, improve, equip, maintain and operate the same,
or may vest jurisdiction for the construction, improvement, equip-
ment, maintenance and operation thereof in any officer, board or
body of said county, or the Commonwealth of Virginia; provided,
however, that said county shall not operate said airport without the
permission of the Corporation Commission first had and obtained.
The board of supervisors of said county may adopt regulations not
in conflict with the rules and regulations adopted and promulgated by
the State Corporation Commission, or which may hereafter be
adopted and/or promulgated by it, and establish fees or charges for
the use of such airport or landing field, or may authorize an officer,
board or body of the county, or any lessee from the county to adopt
such regulations and establish and collect such fees and charges. The
local police authorities of such county and the police authorities of
the State of Virginia, shall have jurisdiction on the premises of any
such airport or landing field operated by the county, or a lessee
from the county.
4. That the county of Henrico acquiring land under the provisions
of this act may lease the same, or part thereof, to any individual or
corporation desiring the use of the same for the purpose of operating
an airport or landing field, or for the purpose of landing or starting
an airplane therefrom, or for other purposes incidental to and in
connection with the operation of said airport, and said county or its
lessee may enter into a contract in the form of a lease providing for
the use of said land, or any part thereof, by the government of the
United States, for the use by said government of said land for avia-
tion purposes, upon nominal or other rental, or without consideration.
5. That the board of supervisors of said county shall have power
to appropriate money annually, or cause to be raised by taxes, any
sums necessary to accomplish the objects of this act, but nothing
herein shall be construed to authorize the said county to contract any
debt unless authorized by general law.
6. That all acts, or parts of acts which are inconsistent herewith
are hereby repealed.
7. That any emergency existing this act shall be in force from its
passage.
