Chap. 257.—-An ACT to authorize the State Commission on Conservation and
Development to acquire, by the exercise of the right of eminent domain in
condemnation proceedings, or by gift, devise, purchase or any other lawful
means, certain lands in the counties of Amelia, Nottoway and Prince Edward,
for public parks or public park purposes; to appropriate for such purpose the
sum of $1,500.00, or so much thereof as shall be necessary; and to authorize
the said commission, through its chairman, to convey, upon certain terms
and conditions, the said lands, or any part thereof, so acquired, to the
United States of America or such department, institution or agency thereof
as may be authorized to accept and preserve the same. [S B 233]

1. Be it enacted by the General Assembly of Virginia, as follows:
Section 1. The lands situated in the counties of Amelia, Nottoway
and Prince Edward on which was fought the last great battle of the
War Between the States, known as the Battle of Saylor’s Creek from
the stream on which the battle was fought, on April sixth, eighteen
hundred and sixty-five, are hereby specifically designated and set apart
as lands suitable for use as a public park and for public park purposes,
and the State Commission on Conservation and Development is hereby
expressly authorized and empowered to acquire title to said lands, or
any part thereof, for such use, by the exercise of the right of eminent
domain in condemnation proceedings, or by gift, devise, purchase or
any other lawful means, provided, however, that in acquiring title to any
of the said property by condemnation proceedings or otherwise, the said
commission shall have no authority to pledge the credit of the State
or incur any indebtedness either on behalf of itself or of the State.
Section 2. Title to all lands and interest in lands herein referred to
which may be acquired by the State Commission on Conservation and
Development under authority of the provisions of this act shall be held
by the commission in trust for the Commonwealth of Virginia, subject
to the following conditions.
Section 3. For the purpose of enabling the State Commission on
Conservation and Development to acquire the property hereinabove
referred to, there is hereby appropriated to the said commission out of
any money in the State treasury not otherwise appropriated the sum
of fifteen hundred dollars, or so much thereof as may be required.
Section 4. The State Commission on Conservation and Develop-
ment is hereby authorized and empowered to transfer and convey to
the United States of America, or such department, institution or
agency thereof as may be authorized to accept and provide for the
preservation of the same, the property, or any part thereof, acquired
by the commission pursuant to any provision of this act, such transfer
and conveyance to be made by deeds signed by the chairman of the
State Commission on Conservation and Development, and shall contain
such conditions, restrictions and reservations as shall be approved by
the Governor and agreed upon by the said commission and the United
States of America, or the department, institution or agency thereof to
which such transfer and conveyance is made.
