Chap. 242.—An ACT to provide for the creation of a Library Building Com-
mission; to prescribe the powers and duties of the said commission; to
authorize the Governor to accept certain real estate on behalf of the Com-
monwealth; and to appropriate $5,000.00 or so much thereof as shall be
necessary, for the purpose of securing architectural plans for said building
and carrying out the provisions of this act. [S B 326]

1. Be it enacted by the General Assembly of Virginia as follows:
Section 1. There is hereby created a State Library Building Com-
mission, hereinafter referred to as the “Commission”, to consist of the
Governor, who shall be chairman thereof, the Lieutenant-Governor,
the Speaker of the House of Delegates, two persons from among the
membership of the Senate to be appointed by the President of the
Senate, two persons from among the membership of the House of Del-
egates to be appointed by the Speaker of the House of Delegates, the
Chairman of the State Library Board, the State Librarian, and two
persons to be appointed by the Governor. The members of the Com-
mission shall receive no compensation for serving thereon, but shall be
entitled to be reimbursed for their actual traveling and hotel expenses
incurred in attending meetings of the Commission. The State Librarian
shall be the secretary of the Commission.
Section 2. The Commission shall ascertain and report the cost of
a building to house the State Library, the Supreme Court of Appeals,
the State Law Library, and the Attorney General.
Section 3. The Commission shall cause to be prepared plans and
specifications for the said building, and for such purpose shall secure
the services of such professional architect or architects as shall be re-
quired.
Section 4. The said Commission shall enter into negotiations with
the authorities of the city of Richmond for the purpose of having
transferred, without cost to the Commonwealth of Virginia, by proper
deed approved by the Attorney General, as the site for the erection of
the said building, that piece or parcel of land in the city of Richmond
known as the Ford Lot, the said property being bounded by Eleventh,
Twelfth, Capitol, and Broad Streets, and in the event such transfer is
made the Governor is hereby authorized to accept the same on behalf
of the Commonwealth.
Section 5. The Commission shall make a full report of its investi-
gations and recommendations together with the architectual plans and
specifications to the next regular session of the General Assembly.
Section 6. In order to provide funds for carrying out the pro-
visions of this act there is hereby appropriated to the said Commis-
sion out of any funds in the State treasury not otherwise appropriated,
the sum of Five thousand dollars, or so much thereof as shall be
required, the money so appropriated to be paid by the Treasurer of
Virginia on warrants of the Comptroller upon vouchers signed by the
chairman of said Commission, or such other person or persons as the
said Commission may designate. The said Commission is hereby
authorized and empowered to accept and receive any grants and gifts
which may be made to the said Commission for the purposes of erect-
ing a State Library building. The appropriation herein made shall not,
for the purposes of sections two and forty-three of the “Act to appro-
priate the public revenue for the two years ending respectively on the
thirtieth day of June, nineteen hundred and thirty-seven, and the thir-
tieth day of June, nineteen hundred and thirty-eight, be included by the
Governor for the purpose of determining whether any deficit results
or will result in the State treasury, but shall be disregarded by him for
such purposes.
