Chap. 231.—An ACT to provide for the appointment of a commission on the
distribution and disposal of surplus State publications; to prescribe the
powers and duties of such commission; and to appropriate funds for certain
expenses in connection with the distribution and disposal of such publications.

1. Be it enacted by the General Assembly of Virginia, as follows:
Section 1. There is hereby created a commission on the distribution
and disposal of surplus State publications, which commission shall be
composed of the Auditor of Public Accounts, the Director of the
Division of Purchase and Printing, and the Director of the Division
of the Budget, which commission shall have the powers and perform
the duties hereinafter prescribed. The members of the commission
shall name one of its members chairman, and another secretary, and
all members of the commission shall serve without additional com-
pensation.
Section 2. The said commission is hereby authorized and directed
to do whatever may be necessary to effect a prompt distribution and
disposal of the large number, estimated as sixty thousand or more, of
surplus State publications now stored in the attic of the Capitol build-
ing in the city of Richmond. In making such distribution and disposal
the said commission shall be guided and controlled by the following
provisions in the order stated:
(a) Such number of the said publications as may be determined
by the commission shall be retained and stored in some suitable place
to be designated by the Governor.
(b) Such documents and publications as the librarian in charge
thereof shall consider of value and desirable for its use shall be de-
livered to each of the following libraries: The Virginia State Library
at Richmond, the State Law Library at Richmond, the Law Library of
the Supreme Court of Appeals at Wytheville, and the Law Library of
the Supreme Court of Appeals at Staunton.
(c) Such publications as may be desired and are available shall be
given to each of the following in the order named: Each college or
university, whether State supported or not; each court of record in
the State; each public library in the State; each State department or
institution making application therefor.
(d) The remaining publications shall be offered for sale as follows:
For the first sixty days not more than one set of Virginia Reports and
one set of the Virginia Code of nineteen hundred and nineteen shall
be sold to any individual, firm or corporation; for the next thirty days
the Virginia Reports and the Virginia Code may be sold in bulk; during
the said ninety day period all other publications may be sold in bulk;
and the Virginia Reports shall be sold for not less than one dollar each,
and the other publications for the best price obtainable.
(e) After the end of the said ninety day period the remaining
volumes and documents other than Virginia Reports may be disposed
of for their value as paper.
(£) All distribution and sale hereunder shall be on written applica-
tions to the commission and delivery to the applicant or purchaser at the
Capitol building.
(g) The commission shall make such rules and regulations as may
be necessary and consistent with good business practices in the dis-
posal of these publications, such rules and regulations to be approved
by the Governor before becoming effective.
Section 3. The said commission, in carrying out its duties under
this act, is authorized to employ two clerks at a salary not to exceed
one hundred dollars a month each for a period of four months, such
salaries and other necessary expenses to be paid out of the money
hereby appropriated. All moneys received by the commission from the
sale of such surplus publications shall be paid into the general fund
of the Commonwealth.
Section 4. In order to carry out the provisions of this act there is
hereby appropriated to the said commission, out of any moneys in the
treasury not otherwise appropriated, the sum of one thousand dollars,
such money, or so much thereof as may be necessary, to be paid by the
Treasurer of the State on warrants of the Comptroller issued on
vouchers signed by the chairman of the commission.
2. An emergency existing, this act shall become effective from its
passage.
