thereof a new section to be numbered Section 4354-a, relating to the collec-
tion of premiums by industrial insurance agents. [S B 172]
Approved March 12, 1936
1. Be it enacted by the General Assembly of Virginia, That the
Code of Virgina be amended by adding to chapter one hundred and
seventy-five thereof a new section to be numbered forty-three hundred
and fifty-four-a, which new section shall read as follows:
Section 4354-a. Industrial Insurance Agents not to Accept Prem-
iums in Arrears or in Advance Except Under Certain Conditions;
Penalty—No agent of an industrial insurance company shall accept
any money in payment of premiums which are in arrears on any in-
dustrial life or industrial sick benefit insurance policy which has
lapsed and which the insured seeks to reinstate, unless such payment
shall amount at least to the total of all premiums in arrears and un-
less such payment shall enable the policyholder to make immediate
application for reinstatement of the policy.
Every advance premium paid by an industrial life or industrial
sick benefit policyholder shall be recorded in the receipt book of the
insured and in the record book of the agent in exactly the same
manner as current premiums are recorded; provided, however, the
failure so to do shall not invalidate the policy.
The State Corporation Commission may suspend or revoke the
certificate of registration of any agent violating the provisions of
this section, the procedure in such cases to conform in so far as pos-
sible to that prescribed by section forty-two hundred and thirty-five.
