Chap. 149.—-An ACT to transfer to and vest in the State Board of Agriculture
and Immigration, to be exercised by it through the Commissioner of Agricul-
ture and Immigration and a Supervisor of Inspection of Apples and Peaches,
certain powers and duties heretofore conferred and imposed by law upon the
Commissioner of Agriculture and Immigration, the Division of Markets, the
Director of the Division of Markets, and the State Board of Agriculture and
Immigration, and to provide compensation for the said supervisor and other
necessary inspectors and employees and the expenses incident to carrying out
the provisions of this act. [S B 234]

1. Be it enacted by the General Assembly of Virginia, That all
the powers conferred, and all the duties imposed by law upon the
Commissioner of Agriculture and Immigration, the Division of Markets,
the Director of the Division of Markets, and the State Board of Agri-
culture and Immigration, relating to the inspecting, grading, marking,
packing, storing, and marketing, of apples and peaches, are hereby
transferred to and vested in the State Board of Agriculture and Im-
migration, which shall exercise the said powers and perform the said
duties through the Commissioner of Agriculture and Immigration and
a Supervisor of Inspection of apples and peaches. The said supervisor
and such inspectors and other employees as shall be found necessary
shall be appointed by the State Board of Agriculture and Immigration
and shall serve at its pleasure. The salary of the said supervisor and
the compensation of the said inspectors and other employees shall be
fixed by the board, subject to the provision that all salaries and
remuneration in excess of one thousand dollars per annum shall first
be approved by the Governor, and subject to the further provision that
the salary of the said supervisor shall not exceed three thousand dollars
per annum.
The salary of the said supervisor and the compensation of the said
inspectors and other employees herein provided for, and the expenses
incident to carrying out the provisions of this act shall be paid by the
Treasurer of the State, on warrants of the Comptroller issued upon
vouchers signed by the Commissioner of Agriculture and Immigration
or such other person or persons as may be designated by the State
Board of Agriculture and Immigration for such purpose, out of the
amounts appropriated to the Division of Markets for administration and
for inspection and grading of agricultural and other commodities and
such other funds as the said State Board of Agriculture and Immigra-
tion shall have available for such purpose, not in excess of the propor-
tion which the revenue derived from the fees for inspection and
grading of apples and peaches bears to the total revenue derived from
the fees for inspection and grading of all commodities.
