Chap. 122.——An ACT to prevent the pollution of certain waters in the county of
York, and to prescribe means for enjoining violations of this act, and to pre-
scribe the duty of the court to which relief is applied for. [S B 137]

1. Be it enacted by the General Assembly of Virginia, That it
shall be unlawful for any person, firm or corporation or municipality
to construct or to use any buildings for the disposal of human wastes
or excrements or to lay or use sewer pipes or stable drains on the
shores of or that drain into the waters of Queen’s Creek in the county
of York so that the drainage from such buildings, sewer pipes or stable
drains shall mingle with the waters of said creek, or to throw or cause
to be thrown any dead animal or animals or fowl or fowls or industrial
waste into the waters of such creek in said county.
The Commonwealth, any county or any individual affected by a
violation of this act shall have the right to proceed by injunction
against any person, natural or corporate, or any municipality, violating
the provisions of this act and, on proof that any such person or munici-
pality is violating the provisions of this act, it shall be the duty of the
court applied to permanently to enjoin such person from further pollut-
ing said waters of Queen’s Creek.
