Chap. 100.—An ACT to amend and re-enact Section 5343 of the Code of Vir-
ginia, as heretofore aménded, relating to courts authorizing payment of
money to infants, or to other persons for their benefit, without the interven-
tion of a guardian. [S B 133]

1. Be it enacted by the General Assembly of Virginia, That section
fifty-three hundred and forty-three of the Code of Virginia, as hereto-
fore amended, be amended and re-enacted so as to read as follows:
Section 5343. Whenever it shall appear to a court, or to the judge
thereof in vacation, having control of a fund or supervision of its
administration, whether a suit be pending theréfor or not, that an in-
fant is entitled to a fund arising from the sale of lands for a division
or otherwise, or as distributee of any estate, or from any other source,
or whenever a judgment, decree, or order for the payment of a sum
of money to an infant is rendered by any court, and the amount to
which said infant is entitled is less than five hundred dollars, or
whenever an infant who has no guardian is entitled to receive pay-
ments of income, and the amount of such income payments is less
than five hundred dollars in any one year, it shall be lawful for the
said court, or the judge thereof in vacation, without the intervention
of a guardian, upon its being made to appear to said court, or the
judge thereof in vacation, that the said infant is of sufficient age and
discretion to use. said fund or said income payments judiciously to
cause said fund or said income payments to be paid directly to said
infant ; and in any case in which said infant is of such tender years,
or is otherwise incapable or incompetent to handle said fund, or said
income payments, it shall be lawful for the court, or the judge thereof
in vacation, in its discretion, to cause said fund or said income pay-
ments to be paid to one of the parents of said infant for the educa-
tion, maintenance and support of said infant; or in event that there is
no living parent capable of handling said fund or said income pay-
ments, to cause said fund or said income payments to be applied to
the maintenance and support of said infant by other means.
