Approved March 2, 1934
1. Be it enacted by the General Assembly of Virginia, That section
three hundred and seventy-five, of chapter twenty-four, of the Code
of Virginia of nineteen hundred and thirty, be amended and re-enacted
so as to read as follows:
Section 375. The Attorney General shall be the chief executive
officer of the department of law. He shall give his opinion and advice,
in writing, when required to do so by the Governor, or by the State
Corporation Commission, or by any of the departments, divisions, com-
missions, boards, bureaus and officers of the State. All legal services,
including the conduct of all litigation in which the Commonwealth is
interested, for the Governor, the State Corporation Commission and all
departments, divisions, commissions, boards, bureaus and officers of
the State shall be performed by the Attorney General. No regular
counsel shall be employed, for or by the Governor, the State Corpora-
tion Commission or any department, division, commission, board, bureau
or officer; no special counsel for the State Corporation Commission or
any department, division, commission, board, bureau or officer of the
State shall be employed except upon the written recommendation of
the Attorney General. The Governor may, however, in an emergency,
declared by the Governor, employ special counsel to perform such legal
services as the Governor may deem proper. Such special counsel shall
be employed only where because of the nature of the service the At-
torney General’s office is unable to render the legal services required.
2. All acts or parts of acts inconsistent with this act are hereby
