Chap. 73.—An ACT to authorize the town of South Hill, in Mecklenburg county,
to abandon a portion of Lunenburg avenue and convey the same to G. L. Smith
and the heirs of Nannie R. Smith, deceased, in exchange for a certain strip
of land to be added to the said Lunenburg avenue. [H B 85]
Approved March 2, 1934
Whereas, there is at present an offset in Lunenburg avenue in the
town of South Hill, in Mecklenburg county, where the same intersects
Atlantic street; and,
Whereas, G. L. Smith and the heirs of Nannie R. Smith, deceased,
own land lying on both sides of Lunenburg avenue, on the northern
side of, and abutting on Atlantic street, and are willing to grant to
the town a triangular parcel of land at the northwestern corner of
the intersection of said avenue and street, in exchange for a similar
parcel at the northeastern corner of said intersection and now included
in said avenue; and,
Whereas, the result of such exchange of lands, and the addition
of the parcel to be acquired by the town thereby, to Lunenburg ave-
nue, would be to eliminate the present offset at the intersection of
said avenue and Atlantic street, and add greatly to the safety and
convenience of the traveling public now, therefore,
1. Be it enacted by the General Assembly of Virginia, as follows:
(a) The town of South Hill, in the county of Mecklenburg, is
hereby authorized to abandon a certain portion of Lunenburg ave-
nue of said town, as hereinafter described; (b) the mayor of said
town is hereby authorized and empowered to convey all the right,
title and interest of the town in the portion so abandoned, to G. L.
Smith and the heirs of Nannie R. Smith, deceased, upon their con-
veying by apt and proper deed, to the said town, a certain parcel of
land adjacent to Lunenburg avenue, as hereinafter described, the
same to be added to and become a part of said avenue; (c) the por-
tion of said avenue to be so abandoned and conveyed is described
as follows: beginning at the present northeastern corner of intersec-
tion of Lunenburg avenue and Atlantic street, the same being a corner
of the land of G. L. Smith and the heirs of Nannie R. Smith, and run-
ning thence northeastwardly with the eastern line of said avenue and
the western line of the land of the said Smiths, three hundred and
sixty-two and twenty-five one-hundredths (362.25) feet to a point in
said line, thence leaving said line and running southwestwardly in a
direct line, three hundred and sixty-seven and sixty-three one-hun-
dredths (367.63) feet to a point thirty-four and seventy-seven one-
hundredths (34.77) feet westwardly from the point of beginning,
thence eastwardly thirty-four and seventy-seven one-hundredths
(34.77) feet to the beginning; (d) the land to be conveyed by the said
G. L. Smith and the heirs of Nannie R. Smith to the said town is
described as follows: beginning at the present northwestern corner
of intersection of Lunenburg avenue and Atlantic street and running
thence westwardly with the north line of said street thirty-four and
seventy-seven one-hundredths (34.77) feet to a point in said line,
thence northeastwardly through the land of the said Smiths three
hundred and sixty-seven and sixty-three one-hundredths (367.63) feet
to a point in the present western line of Lunenburg avenue, thence
with said line southwestwardly three hundred and sixty-two and twenty-
five one-hundredths (362.25) feet to the beginning.
2. An emergency existing, this act shall be in force from its passage.
