Chap. 71.—An ACT to authorize and empower the council of the city of Hampton
to convey all the right, title and interest of the said city in and to a certain
portion of Shield street to Virginia Public Service Company in exchange for
certain other real estate in said city. [H B 81]

Whereas, Virginia Public Service Company owns a certain strip
of land sixty (60) feet in width extending in a southerly direction from
the southerly end of Armistead avenue in the city of Hampton to Her-
bert’s creek by dedication of which, the said Armistead avenue could
be extended the length of one block to said Herbert’s creek; and
Whereas, the property on both sides of Shield street, which runs
parallel with Armistead avenue and one block west therefrom, from
Hess street to Herbert’s creek, is also owned by Virginia Public Ser-
vice Company, and on which its power house and loading docks are
located; and,
Whereas, an agreement has been reached between the council of the
city of Hampton and the Virginia Public Service Company by which
the city will convey to the Virginia Public Service Company all its
right, title and interest in that portion of Shield street extending south-
wardly from Hess street to Herbert’s creek, in exchange for a strip
of land located immediately south of Armistead avenue, sixty (60) feet
in width and extending from the southern end of Armistead avenue
southwardly from Hess street to Herbert’s creek, the same to be dedi-
cated as a public street, thereby extending Armistead avenue to the
waters of Herbert’s creek; and,
Whereas, the said exchange has been approved as in the public
interest by the council of the city of Hampton, by resolution of the
said council adopted at a regular meeting held on the twenty-fifth day
of January, nineteen hundred and thirty-four; and it is now desired
by the said council and the said Virginia Public Service Company,
that the said exchange agreement be carried out and consummated;
now, therefore,
1. Be it enacted by the General Assembly of Virginia, That the
council of the city of Hampton be, and it is hereby, authorized and em-
powered to convey, by an apt and proper deed, signed by the mayor
and the clerk of the council of the said city, to the Virginia Public
Service Company all the right, title and interest of the said city in and
to that part of Shield street extending southwardly from Hess street
to Herbert’s creek, upon the said Virginia Public Service Company
opening and dedicating by a good and sufficient deed or other instru-
ment, a public street through its property, sixty (60) feet in width
and extending from the southern end of Armistead avenue south-
wardly from Hess street to Herbert’s creek.
2. An emergency existing, this act shall be in force from its passage.
