relating to vacation powers of chancery judges, and effect of vacation decrees

1. Be it enacted by the General Assembly of Virginia, That section
sixty-three hundred and seven of the Code of Virginia, be amended and
re-enacted so as to read as follows: |
Section 6307. Vacation powers of chancery judges; when to be ex-
ercised; effect of vacation decrees and orders.—Judges of courts ex-
ercising chancery jurisdiction shall have the same jurisdictional powers
over chancery causes in vacation as is conferred upon such courts in
term, but such jurisdiction shall not be exercised except after ten days’
notice to all parties to be affected thereby, or their counsel. Chancery
causes, however, submitted in term may be decided in vacation without
such notice; nor shall any notice be necessary to a defendant proceeded
against by an order of publication as to whom the cause has been ma-
tured and who has not entered an appearance. Decrees and orders in
vacation heretofore or hereafter signed at any place in this State, shall
have the same force and effect as if made in term, but the lien of such
decree or order shall take effect only from the time of day at which it
is received by the clerk to be entered of record.
