Chap. 53.-An ACT to amend and re-enact sections 1224, 1225 and 1227 of th
Code of Virginia, as heretofore amended concerning tuberculosis and Bang’:
disease among cattle. [S B 147

1. Be it enacted by the General Assembly of Virginia, That section:
twelve hundred and twenty-four, twelve hundred and twenty-five anc
twelve hundred and twenty-seven of the Code of Virginia, as heretofore
amended, be amended and re-enacted so as to read as follows:
Section 1224. With the view to detecting, controlling and finally
eradicating the diseases known as tuberculosis and Bang’s disease fron
cattle in Virginia, it shall be the duty of the State Board of Agricul
ture and Immigration, at the request of the owner, except as hereinafter
provided, to have the tuberculin test applied to any cattle in Virginia
suspected of being affected with such disease, and the agglutination test
for Bang’s disease applied to any cattle in Virginia suspected of being
affected with Bang’s disease, such tests to be made under such rules
and regulations as said board may from time to time prescribe, and
through such agerficies as it may appoint for such purpose.
In every county co-operating with the State in its work and efforts
to eradicate such diseases, owners of cattle shall be compelled to submit
them to tuberculin testing and to tests for Bang’s disease at such time
or times as the board of supervisors of any such county and the State
Board of Agriculture and Immigration may deem the same necessary
and expedient.
All cattle found upon any tuberculin test or by any physical ex-
amination to be affected with tuberculosis, and all cattle re-acting posi-
tive to the agglutination test for Bang’s disease in the laboratories of the
Virginia Department of Agriculture and Immigration shall be con-
demned and promptly quarantined, and report thereof made to the
State Board of Agriculture and Immigration; all such cattle shall be
appraised at their fair cash value by three persons, one to be ap-
pointed by the State board, or its duly authorized agent, one by the
owner, and the other by the two thus selected, which appraisement shall
be made in writing and shall be returned to said board. After such
appraisal shall have been so made and returned, the owner or owners of
such diseased cattle shall cause them to be slaughtered within thirty
days from the date of such test or examination, and the carcasses dis-
posed of under such rules and regulations as said State board may pre-
scribe, and the proceeds thereof paid to the owner. All cattle affected
with tuberculosis shall be slaughtered under State or Federal super-
vision.
Report shall be made to the State Board of Agriculture and Immi-
gration of all tuberculin testing and Bang’s disease testing of cattle in
Virginia, whether such tests be made by agents of said board or by
other persons, within five days after such testing; to the end that the
public may have knowledge of this requirement, the said board shall
from time to time circularize this section and furnish copies thereof to
all veterinarians in the State.
Section 1225. The said Board of Agriculture and Immigration, out
of funds which may from time to time be appropriated by the State of
Virginia for the purpose, shall, subject to the conditions set forth in
this section (a) compensate the owner of cattle affected with tubercu-
losis and slaughtered under the provisions of section twelve hundred
and twenty-four, in counties co-operating with the State in tuberculosis
eradication and, whether in any such county or not, for all such cattle
so slaughtered from herds containing three or more cattle accredited
or in process of being accredited, and (b) compensate the owners of
cattle affected with Bang’s disease and slaughtered under the provisions
of section twelve hundred and twenty-four, in counties co-operating
with the State in Bang’s disease eradication, and, whether in any such
county or not, for all such cattle so slaughtered trom herds contaiming
three or more cattle certified or in process of becoming certified. Before
any such compensation shall be paid for cattle affected with Bang’s
disease and slaughtered, the owner or owners thereot shall file with the
State Board of Agriculture and Immigration a statement under oath
as to the slaughter of such animals.
The compensation to be paid for such slaughtered cattle shall be
equal to one-third of the difference between the appraised value and
the salvage value of the animal so slaughtered, provided, no such pay-
ment shall exceed twenty dollars for any grade or unregistered animal,
or forty dollars for any pure bred or registered animal, and provided
further no payment shall be made on account of any animal imported
into the State unless and until such animal shall have passed within Vir-
ginia at least one negative test for the disease for which it is slaughtered.
Not more than ten per centum of any funds appropriated by the
State of Virginia for any fiscal year for the purposes herein set forth,
shall be expended during such year for cattle so slaughtered in any one
county, unless the Board of Agriculture and Immigration shall other-
wise determine.
Section 1227. (a) The State Board of Agriculture and Immigration
shall make and publish, from time to time, stich reasonable rules and
regulations as it may deem proper for carrying into effect the provisions
of sections twelve hundred and twenty-four and twelve hundred and
twenty-five ; and the actual and necessary expenses incident thereto shall
be audited and paid as other expenses of said board.
(b) Any persons who shall violate, disregard, evade, or attempt to
violate, disregard or evade any of the provisions of section twelve hun-
dred and twenty-four or section twelve hundred and twenty-five, or the
rules, regulations or orders of the State Board of Agriculture and Immi-
gration, made and adopted for the purpose of carrying the provisions
of such sections into effect, and any agent, officer or inspector who shall
wilfully fail to comply with such rules and regulations, or with any of
the provisions of either of said sections, shall be deemed guilty of a
misdemeanor, and upon conviction, shall be fined not less than ten
dollars nor more than one hundred dollars for each offense.
(c) Any person who shall, otherwise than in accordance with such
rules and regulations as may be adopted by the State Board of Agri-
culture and Immigration, alter, deface, change from one animal to an-
other, mutilate, substitute, remove, misrepresent, or otherwise interfere
with any tag, brand, tattoo, mark, or other identification adopted or
used by any county in this State, by the Board of Agriculture and Immi-
gration of this State, by the United States Bureau of Animal Industry,
or by any other State, for the identification of any animal or animals in
this State or shipped into this State, affected with tuberculosis or Bang’s
disease, suspected of being so affected, or undergoing tests to determine
whether such animal or animals are so affected, shall be deemed guilty
of a misdemeanor and upon conviction shall be fined not less than ten
dollars and not more than one hundred dollars for each such offese.
