Chap. 367.—An ACT to authorize the Director of the Division of Markets, with
the approval of the Commissioner of Agriculture and Immigration, to co-
operate with Federal officials, national, district and State committees and super-
visory bodies in establishing and enforcing codes and marketing agreements
adopted under the Federal Agricultural Adjustment Act and amendments
thereto and other similar Acts' of Congress; to make agreements for carrynig
out the provisions of this act and the Federal Agricultural Adjustment Act
and amendments thereto and other similar Acts of Congress; to appoint,
supervise and dismiss inspectors and representatives for carrying out the
purposes of this act; to receive fees and moneys for carrying out the purposes
of this act and to provide for the distribution thereof; to adopt and make
effective any or all codes and agreements approved by Federal officials under
the Agricultural Adjustment Act and acts amendatory thereto and similar
Acts of Congress; to provide that such code or marketing agreement when
approved by the Governor shall become effective in intrastate commerce in
this State; and to prescribe penalties for violations of this act. [S B 239]

1. Be it enacted by the General Assembly of Virginia, as follows:
Section 1. The Director of the Division of Markets with the approval
of the Commissioner of Agriculture and Immigration is hereby em-
powered and directed, in his discretion:
(a) To co-operate with Federal officials, national, district and/or
State committees and/or supervisory bodies in establishing and/or en-
forcing codes and/or marketing agreements adopted under the Federal
Agricultural Adjustment Act and/or amendments thereto and/or other
similar Acts of Congress.
(b) To make agreements with Federal officials, national, district
and/or State committees and/or supervisory bodies for carrying out
the provisions of this act and/or the Federal Agricultural Adjustment
Act and/or amendments thereto and/or other similar Acts of Congress.
(c) To appoint, supervise and dismiss as inspectors and/or repre-
sentatives of the Division of Markets for carrying out the purposes
of this act such of the employees of his office as he may deem necessary
for the enforcement and carrying out the purposes of this act.
(d) To receive from the Federal department and/or subdivisions
thereof, national, district and/or State committees and/or supervisory
bodies, or from other sources fees and/or moneys for carrying out the
purposes of this act, deposit them in the State treasury and spend such
moneys for carrying out the purposes of this act under the existing
laws and/or rules and regulations of the State.
Section 2. The Director of the Division of Markets, with the ap-
proval of the Commissioner of Agriculture and Immigration and with
the approval of the Governor is hereby authorized, in his discretion, to
adopt and make effective in the State of Virginia any or all codes
and/or marketing agreements approved by Federal officials under the
Agricultural Adjustment Act and/or acts amendatory thereto and/or
similar Acts of Congress.
Section 3. Any code or marketing agreement when approved by the
Governor shall become effective in intrastate commerce in this State.
Section 4. Any person, firm, association, or corporation who shall
violate any of the provisions of this act and/or code and/or marketing
agreement adopted under the provisions of this act shall be punished
by a fine of not less than five ($5.00) dollars nor more than five hun-
dred ($500.00) dollars for each offense.
Section 5. The Director of the Division of Markets with the ap-
proval of the Commissioner of Agriculture and Immigration, is hereby
empowered and directed, in his discretion, to cause prosecutions for vio-
lations of this act to be instituted through the Commonwealth’s attor-
neys of this State, or otherwise, in counties or cities of the State of
Virginia where in his opinion violations of this act are found.
Section 6. If any section, subsection, sentence, clause or phrase of
this act is for any reason held to be unconstitutional, such decision shall
not affect the validity of the remaining portions of this act.
