Chap. 359.—An ACT for the relief of Margaret F. McMurran. [S B 20]

Whereas, on the twelfth day of January, nineteen hundred and
thirty-two, Margaret F. McMurran was driving her automobile on and
along the State highway known as the George Washington highway
in Norfolk county at a point on said highway about six (6) miles
south of the village of Deep Creek, when her said automobile was
run into and struck by the negligent operation of a truck owned and
operated by the State Highway Department of the State of Virginia,
and by reason of the negligent operation of said highway truck, her
automobile was demolished and she was seriously injured; and,
Whereas, Margaret F. McMurran obtained a judgment against the
driver of said State highway truck on the fifth day of December, nine-
teen hundred and thirty-two, in the circuit court of Norfolk county,
and the said driver is insolvent; and,
Whereas, the said truck was insured by the State Highway Depart-
ment with the Independence Indemnity Company of Philadelphia, but
after the rendition of said judgment and before anything was col-
lected thereon, the said insurance company went into the hands of
receivers and nothing was collected on account of said judgment; and,
Whereas, the State should be primarily responsible for said judg-
ment, yet no action can be brought against the State for a tort of this
nature without its consent, which consent has not been given; now,
therefore,
1. Be it enacted by the General Assembly of Virginia, That there
be and is hereby appropriated the sum of fifteen hundred dollars
($1,500.00) payable out of the fund in the State treasury for the con-
struction and reconstruction of State highways, and the Comptroller
is hereby authorized and directed to draw his warrant upon the Treas-
urer of Virginia for fifteen hundred dollars ($1,500.00) payable to
Margaret F. McMurran in full for her claim.
