Chap. 355.—An ACT to restore to the State Corporation Commission certain
unexpended amounts collected from certain classes of public service corpora-
tions under the provisions of an act of the General Assembly of Virginia, Acts
1924, page 536, now section 230 of the Tax Code, which amounts have been cov-
ered into the general funds of the treasury under the provisions of an act
of the General Assembly of Virginia, Acts 1928, page 35, known as the Tax
Code of Virginia. [H B 373]

Whereas, the General Assembly of Virginia did, by an act passed
in nineteen hundred and twenty-four, chapter three hundred and
seventy-four, Acts nineteen hundred and twenty-four, page five hun-
dred and thirty-six, impose certain taxes upon certain public service
corporations for the purpose of raising funds for the appraisal and
valuation of such public service corporations; and,
Whereas, various amounts were collected thereunder for the years
from June thirtieth, nineteen hundred and twenty-five, to June thirtieth,
nineteen hundred and thirty-three, inclusive, and only parts of the
amounts so collected were expended for the purposes for which col-
lected, during the several years in which said amounts were collected;
and,
Whereas, the unexpended portions in each of the several years,
June thirtieth, nineteen hundred and twenty-five, to June thirtieth, nine-
teen hundred and thirty-three, inclusive, have been covered into the
general funds of the treasury, by virtue of an amendment to the said
act of nineteen hundred and twenty-four, being section two hundred
and thirty of the Tax Code of Virginia, Acts of Assembly, nineteen
hundred and twenty-eight, page thirty-five; and,
Whereas, these taxes were imposed and collected for a special pur-
pose, and should be used solely for such purpose; now therefore
1. Be it enacted by the General Assembly of Virginia, That the
sum of sixty thousand dollars ($60,000.00) be, and the same hereby is,
appropriated and restored and credited to the State Corporation Com-
mission, which said amount shall be in full of all sums heretofore
covered into the general fund for expenditure by it in accordance with
the provisions of the act of nineteen hundred and twenty-four, Acts
of Assembly of Virginia, nineteen hundred and twenty-four, page five
hundred and thirty-six, to be used by the State Corporation Commis-
sion as a special fund for the purpose of making appraisals and valu-
ations of the properties of certain public service corporations whenever
the same shall be deemed necessary by the commission, and for the per-
formance of other functions of the State Corporation Commission, and
that the said amount, and all taxes hereafter collected, under the said
act of nineteen hundred and twenty-four, now section two hundred and
thirty of the Tax Code of Virginia, as amended, be, and they hereby
are, appropriated for the purpose of carrying out the provisions of the
said act of nineteen hundred and twenty-four, and all payments from
the fund hereby restored to the commission, and all future collections
under said act, as amended, or as it may hereafter be amended, shall
be upon the order of the State Corporation Commission, attested by
its clerk.
