Chap. 344.—An ACT to amend and re-enact an act entitled an act for the pro-
tection of fish, squirrels and other game in Buchanan county, approved March
24, 1932, and to prescribe penalties for violations thereof. [fH B 293]

1. Be it enacted by the General Assembly of Virginia, That an
act entitled an act for the protection of fish, squirrels and other game
in Buchanan county, approved March twenty-fourth, nineteen hun-
dred and thirty-two, be amended and re-enacted so as to read as fol-
lows:
Section 1. It shall be unlawful for any person to take, catch,
or destroy, in any of the waters of Buchanan county, any fish between
the thirty-first day of January and the first day of July following,
except that any person holding a fishing license, or any person under
sixteen years of age, may gig or snare suckers in the day-time from
the first day of December to the first day of March following.
Any person violating the provisions of this section shall, upon
conviction, be fined not less than five dollars nor more than twenty-
five dollars.
Section 2. It shall be unlawful for any person to catch, or take
any fish in any waters of Buchanan county at any time by the means
of drag seines or trammel nets of any kind. It shall be unlawful
for any person to have in his possession any such seines or trammel
nets, and any such seines or trammel nets shall by order of court or
justice, be forfeited to the Commonwealth, and may be seized by
any officer as forfeited, and the court or justice shall order the same
to be destroyed.
Any person violating any of the provisions of this section shall,
upon conviction, be fined not less than twenty-five dollars, nor more
than two hundred dollars, or confined in jail for a period of not less
than ten nor more than thirty days, or both in the discretion of the
court or jury trying the case.
Section 3. It shall be unlawful for any person to use fish berries,
lime, giant powder, dynamite, guns or any explosive or chemical sub-
stance of any kind for the destruction, taking or catching of fish in
any creek, pond, river or waters of Buchanan county at any time.
Any person violating any of the provisions of this section shall,
upon conviction, be fined not less than fifty dollars, nor more than
two hundred dollars, and confined in jail for a period not less than
one month nor more than six months.
Section 4. It shall be unlawful for any person to hunt, trap, or
in any other manner take or kill any squirrels in Buchanan county,
except on his own land, between the thirty-first day of December
and the first day of September following. It shall also be unlawful
for any person to catch or kill more than ten squirrels in one day,
and any person who is found with more than ten squirrels in his pos-
session at one time shall be deemed prima facie guilty of killing more
than ten squirrels in one day. It shall be unlawful for any person to
buy or sell, or offer to buy or sell, any squirrel or squirrels in Buch-
anan county, or to take any squirrel or squirrels caught or killed in
said county out of said county for the purpose of selling the same;
provided, however, any person shall have the right to kill squirrels on
his own land at any time, for the protection of his crops.
Section 5. It shall be unlawful for any person to hunt, trap,
or in any other manner take or kill any raccoon in Buchanan county
between the thirty-first day of December and the fifteenth day of
November following. It shall be unlawful to hunt any opossums,
mink, or skunks in Buchanan county between the thirty-first day of
January and the first day of November following. And it shall be
lawful to hunt rabbits in Buchanan county from the fifteenth day
of November to the thirty-first day of January.
Section 6. Any person who shall violate any of the provisions
of either of the two preceding sections shall, upon conviction thereof,
be punished by a fine of not less than five dollars nor more than
twenty-five dollars; and any person who shall aid or abet another in
violating any provision of this act shall be deemed an accessory, and
upon conviction thereof shall be punished as if he were the principal.
