Chap. 299.—An ACT to amend the Code of Virginia by adding thereto a new
section numbered section 2769-a fixing the pay of supervisors of counties;
and to repeal section 2769 of the Code of Virginia, as heretofore amended.

1. Be it enacted by the General Assembly of Virginia, That the
Code of Virginia be amended by adding thereto a new section num-
bered twenty-seven hundred and sixty-nine-a, which new section shall
read as follows:
Section 2769-a. Each member of the board of supervisors shall be
allowed, and paid out of the county levy, a compensation for his ser-
vices in attending the meetings of the board and in discharging such
other duties as may be imposed upon him by law at a rate of not exceed-
ing six dollars per diem for the time he shall be actually so employed, and
five cents for each mile of travel in going to and returning from the
place of meeting of said board, but no per diem allowance shall be made
for any time occupied in traveling where mileage is allowed therefor
and only one mileage shall be allowed for any one term of meeting of
such board; provided, that on and after July first, nineteen hundred
and thirty, the rate of compensation for such services of members of
the board of supervisors of the county of Floyd shall not be more
than five dollars per day and mileage; and provided, further, that on
and after January first, nineteen hundred and twenty-eight, the rate
of compensation for such services of members of the board of super-
visors of the county of Botetourt shall not be more than five dollars
per day and actual expenses while attending meetings of the board, in-
stead of six dollars per day and mileage, as aforesaid.
No supervisors shall draw pay for more than eighteen days in coun-
ties of ten thousand population and less, and in addition thereto, they
may be paid five cents per mile for each mile necessarily traveled in at-
tending such meetings, and except that supervisors in the county of
Dickenson may draw pay for not more than twenty-five days and super-
visors in the county of Westmoreland may draw pay for not more than
forty days; and except that each member of the board of supervisors
of Warwick county may be paid as compensation for his services in
the supervision of the opening and repair of the public roads or con-
struction and repair of bridges in their respective districts, shall receive
six dollars per diem for the time necessarily so employed, nor shall he
draw pay for more than twenty-five days in counties of more than ten
thousand and less than thirty thousand population, except in the coun-
ties of Campbell and Isle of Wight the members of the board may draw
pay for not more than fifty days in any year in which they shall be ac-
tually engaged in performing services in connection with any National
Industrial Recovery Act or program, and in any year in which they will
not be so engaged they shall draw pay for not more than twenty-five
days, nor shall he draw pay for more than thirty days in counties of
thirty thousand population and not over forty thousand, and in counties
of over forty thousand population he shall draw pay for not more than
forty days in any one year; provided, that in the county of King George
each supervisor shall be paid two hundred dollars per annum in lieu
of per diem and mileage and in the county of Pulaski each supervisor
shall be paid two hundred dollars per annum, and in addition thereto,
he may draw pay and mileage for not to exceed fifteen days in any year,
for attendance upon board meetings. With the consent of the circuit
court of their respective counties, the supervisors of Henrico, Chester-
field and Nansemond counties may receive as much as four hundred
dollars each per annum and the supervisors of Roanoke and Brunswick
counties, with the consent of the circuit court of said counties, may re-
ceive as much as two hundred and fifty dollars per annum, and mileage
as above provided, and the supervisors of the county of Henry, with
the consent of the circuit court of said county may receive as much as
two hundred dollars each per annum, and mileage as above provided,
and the supervisors of the county of Alleghany, with the consent of the
circuit court of said county, may receive as much as six hundred dollars
each per annum and mileage, as above provided, and the supervisors of
the county of Rockingham, with the consent of the circuit court of said
county, may receive as much as three hundred dollars each per annum
and mileage as above provided, and the supervisors of the county of
Shenandoah, with the consent of the circuit court of said county, may
receive as much as one hundred and seventy-five dollars each per an-
num, and mileage, as above provided ; and the supervisors of the county
of Loudoun with the consent of the circuit court of said county, may
receive as much as two hundred dollars each per annum and mileage as
above provided; and the supervisors of Elizabeth City county may with
the consent of the circuit court of said county, receive as much as three
hundred and fifty dollars each per annum, in addition to the compen-
sation they would be entitled to receive under the general provisions of
this section, the same to be paid upon warrants issued by said board
on the general county fund of said county, and the supervisors of Fair-
fax county may receive as much as four hundred dollars each per an-
num.
Each member of the board of supervisors of Rockbridge county, for
their services in the supervision of the general county affairs, and for
special duties imposed upon them by said board, shall, each receive the
sum of six dollars per diem, and in addition thereto five cents for each
mile necessarily traveled in connection with the discharge of such duties,
and may receive more than five hundred dollars for such services with
the consent and approbation of the circuit court of said county, and
each member of the board of supervisors of the county of Norfolk may
receive not exceeding five hundred dollars per annum and mileage, as
herein provided. |
In the county of Augusta, any supervisor may, with the consent of
the circuit court, be paid as compensation for any special duties im-
posed upon him by the board of supervisors or the general law at the
rate not to exceed six dollars per diem for the time actually engaged
with mileage provided for regular service, but this extra compensation
shall not exceed the sum of three hundred dollars per year for any
one supervisor.
Each supervisor of the counties of Buchanan, Mecklenburg, Sussex,
Prince George, Russell and Greensville may, in addition to mileage, re-
ceive the sum of eight dollars per day during the time the boards of
said counties are in actual session. And each supervisor of Pittsylvania
county, for his services as supervisor while the board is in actual ses-
sion, shall receive six dollars per day for not exceeding fifteen days for
any one year and mileage as herein provided.
And the members of the board of supervisors of Amherst county
and the county of Dinwiddie shall receive three hundred dollars per
annum, in lieu of per diem allowance and mileage; provided that if any
member does not attend all meetings of the board, such member shall
only be paid that proportion of said three hundred dollars which the
number of meetings attended bears to the whole number of meetings
held. And the members of the board of supervisors of Pittsylvania
county may receive as their compensation an annual salary not to exceed
the sum of four hundred and fifty dollars, payable monthly, quarterly
or in semi-annual installments, which salary shall be in lieu of all other
compensation for their services as such. and the members of the board
of supervisors of Halifax and York counties may receive as their com-
pensation an annual salary not to exceed the sum of three hundred dol-
lars, payable monthly, which salary shall be in lieu of all other compen-
sation for their services as such, and the members of the board of su-
pervisors of Wise county may receive as their compensation an annual
salary of not less than four hundred and twenty dollars and not to ex-
ceed six hundred dollars, payable monthly, which salary shall be in lieu
of all other compensation for their services as such; provided that the
salary fixed each year shall be approved by the judge of the circuit court
of said county, by an order entered of record.
2. Be it further enacted by the General Assembly of Virginia,
That section twenty-seven hundred and sixty-nine of the Code of Vir-
ginia, as amended, be, and the same hereby is, repealed.
Nothing herein contained shall apply to any county which has
adopted any form of county organization and government provided for
in sections 2773-a to 2773-n both inclusive, of the Code of Virginia.
