Chap. 27.—An ACT to amend and re-enact section 6028 of the Code of Virginia,
as heretofore amended, relating to appeals of cases from justices courts.

1. Be it enacted by the General Assembly of Virginia, That section
sixty hundred and twenty-eight of the Code of Virginia, as heretofore
amended, be amended and re-enacted so as to read as follows:
Section 6028. When an appeal is taken from the judgment of a
justice of the peace, civil justice, civil and police justice or a justice of
a municipal court, the party taking such appeal shall, within thirty days
from the date of such judgment, pay to the clerk of the court to whict
such appeal has been taken the amount of the writ tax as fixed by law.
and four dollars on account of costs in the appellate court, and in the
event of his failure to do so, the appeal shall stand dismissed, and the
judgment of the justice of the peace, civil justice, civil and police justice
or a justice of a municipal court affirmed, and the original papers shall
be returned to the said justice, civil justice, civil and police justice or a
justice of a municipal court, who shall enter judgment against any surety
given at the time of appeal as a matter of course.
