Chap. 244.—An ACT to create the Hampton Roads Sewage Disposal Commission,
to authorize appointment of the members thereof, to provide for the organiza-
tion and duties of said commission, and to authorize the co-operation of the
various counties, cities, and towns in the area known as the Chesapeake bay
area, as herein defined, to permit contracts and other arrangements between
the counties, cities and towns and the State and Federal agencies located in
such area, or any of them, to permit issuance of bonds and securing of loans
and grants from the Federal government, and to permit the preparation of a
plan looking toward the elimination of pollution in said area, to authorize the
said commission to accept grants of money from the Federal government, or
any agency thereof, and provide that the same be paid into the State treasury
for use in carrying out the provisions of this act, and to appropriate such
money for such purpose. [S B 292]

1. Be it enacted by the General Assembly of Virginia, as follows:
Section 1. There is hereby created as an agency of the Common-
wealth of Virginia, the “Hampton Roads Sewage Disposal Commis-
sion,” which shall consist of five members, who shall be appointed by
the Governor, at least three of whom shall be residents of the section
familiarly known as Tidewater Virginia. The Governor shall have the
right to remove, with or without cause, any one or more of the com-
missioners and to appoint a successor or successors and also the right
to fill vacancies, however the same may occur. The said appointees
shall serve until fifteen days after the expiration of the term of the
Governor, unless sooner removed by the Governor.
Section 2. The commissioners, upon their organization, shall elect
one of their number as chairman and another as vice-chairman. Three
members of the commission shall constitute a quorum. The Commis-
sioner of Fisheries, upon request of the commission hereby created,
shall furnish to the said commission one of his employees for part of
his time without any increase in salary, who shall be charged with the
execution of its purposes and furtherance of its policies and the per-
formance of such duties as may be imposed upon him by the said com-
mission. Necessary office space, stationery, stamps, and typewriters
shall be furnished the commission by the Commissioner of Fisheries.
Section 3. It shall be the duty of the commission to draft a plan
for the elimination of pollution by sewage or otherwise of the tidal
waters or any part of such waters within the area known as the Chesa-
peake bay area, the final determination of which shall be left to the
commission, which area, however, shall include the tidal waters made
up by the eastern, southern and western branches of the Elizabeth
river, the Nansemond and James rivers, Chuckatuck creek, Hampton
creek and lesser tributaries. The commission shall endeavor to work
out for submission to the various counties, cities and towns in the
area it selects a definite plan of eliminating pollution of the tidal waters
of the area, including a plan for taking advantage of chapter fifty-eight
of Acts of Assembly of nineteen hundred and thirty-three, which act
authorizes counties, cities and towns to enter into contracts relative to
eliminating pollution of the waters of the State, and chapter twenty-
six of the same Acts relating to local bond issues and loans and grants
from the Federal government, to the end that definite steps may be
taken to terminate pollution in the aforesaid Chesapeake bay area.
Section 4. In addition to the powers given to the counties, cities,
and towns of the State to enter into contracts with each other as pro-
vided by chapter fifty-eight of the aforesaid Acts, authority is also
given to such counties, cities, and towns to likewise include in such
contracts, agencies or departments of the State and Federal govern-
ments located in the Chesapeake bay area. It is expressly understood
that the commission is to have no authority other than to draft such a
plan and endeavor to secure the co-operation of the various counties,
cities and towns in the area, as well as that of the Federal and State
governments and their respective departments and agencies.
Section 5. The commission is hereby authorized and empowered tc
accept grants of money from the Federal government, or any agency
thereof, for the purpose of carrying out the provisions of this act, and
any and all money so granted shall be promptly paid by the commissior
into the State treasury and there set up as special fund for such purpose.
The chairman of the commission shall be paid as compensation for his
services a salary to be fixed by the Governor, but not to exceed the
sum of thirty-six hundred dollars per annum. The other members of
the commission shall receive no salaries, but shall be paid a per diem
of ten dollars for each day devoted by them to the performance of their
duties, and each member of the commission shall also be paid his neces-
sary traveling and other expenses incurred in his attendance upon meet-
ings and while otherwise engaged in the discharge of his duties as such
commissioner.
There is hereby appropriated for the purpose of paying the salary,
compensation and expenses above provided for, so much of any money
which may be so granted by the Federal government, or any agency
thereof, and paid into the State treasury, as may be necessary for such
purpose, all such payments to be made by the Treasurer upon the war-
rants of the Comptroller, issued upon vouchers signed by the chairman
of the commission; provided, however, instead of paying into the State
treasury such money as may be granted the commission by the Federal
government, or any agency thereof, for the aforesaid purpose, the
commission may, if the authority making such grant shall so direct,
disburse the money so granted, in the payment of such compensation
and expenses of the members of the commission as may be prescribed
by the authority making such grant; provided, further, no such’ com-
pensation or expenses shall be paid by the State.
