Chap. 185.—An ACT to amend chapter 6 of an act entitled an act to provide a
new charter for the city of Portsmouth, approved March 10, 1908, by adding
a new section thereto to be designated as section 70-a, providing that the
council of said city may establish a system of pensions for injured, retired or
superannuated members of the police and fire departments and prescribing how
funds may be raised for such purposes. [H B 190]

1. Be it enacted by the General Assembly of Virginia, That chapter
six (6) of an act entitled an act to provide a new charter for the city
of Portsmouth, approved March tenth, nineteen hundred and eight, be
amended by adding a new section thereto to be designated as section
seventy-a and to read as follows:
Section 70-a. The council may, by ordinance adopted by a recorded
vote of a majority of the members elected to each branch thereof, es-
tablish a system of pensions for injured, retired or superannuated
members of the police and fire departments of said cities, or of either
of such departments. Said ordinance may establish a fund for the
payment of such pensions, either by making appropriations out of the
treasury of the city, by levying a special tax for the benefit of said
fund, by requiring contributions, payable from time to time from the
active members of such departments, or by any other mode not pro-
hibited by law. Any such pensions as may be so provided for shall be
payable in such sum, or sums, and at such time, or times, as may be
prescribed in said ordinance; provided, however, if any member ot
either the police or fire department shall leave the service for any cause
or reason, there shall be paid to him not less than one-half of such
amounts, if any, as may have been deducted from his salary on account
of contributions which he may have been required to make to the
pension fund.
