Chap. 164.—An ACT to validate conveyances of real estate by executors given
power of sale under wills admitted to probate in other jurisdictions and to
declare valid and effectual conveyances made hereafter under similar condi-
tions; and to repeal an act entitled an act to validate conveyances of real
estate by executors given power of sale under wills admitted to probate in
other jurisdictions, approved March 14, 1924. [S B 47]

1. Be it enacted by the General Assembly of Virginia, That every
conveyance of real estate within this State heretofore made by the
executor or executors of a will which, prior to such sale, has been pro-
bated.according to the laws of another state shall, without the qualifica-
tion of the executor or executors in this State, be as valid and effectual
to pass the title of such real estate as if the executor or executors named
in such will and making said conveyance had qualified in this State, in
every case where the will under which said executor or executors have
acted is duly executed according to the laws of this State as a valid
will and confers upon the executor or executors the power to convey
the real estate so conveyed, and an authenticated copy of such will has
been admitted to probate in this State, and in the county or city in which
the real estate or any part thereof is situated. And every such con-
veyance of real estate within this State hereafter made by such executor
or executors shall be likewise valid and effectual to pass the title of
such real estate if the conditions hereinabove set forth are complied
with, and in addition thereto an ancillary administrator upon the estate
of such decedent has been duly appointed and qualified.
2. Be it further enacted by the General Assembly of Virginia, That
an act entitled an act to validate conveyances of real estate by executors
given power of sale under wills admitted to probate in other jurisdic-
tions, approved March fourteenth, nineteen hundred and twenty-four,
be, and the same is hereby, repealed.
